Court won't review Obama's eligibility to serve

WASHINGTON (AP) -- The Supreme Court has turned down an emergency appeal from a New Jersey man who says President-elect Barack Obama is ineligible to be president because he was a British subject at birth.

The court did not comment on its order Monday rejecting the call by Leo Donofrio of East Brunswick, N.J., to intervene in the presidential election. Donofrio says that since Obama had dual nationality at birth - his mother was American and his Kenyan father at the time was a British subject - he cannot possibly be a "natural born citizen," one of the requirements the Constitution lists for eligibility to be president.

Donofrio also contends that two other candidates, Republican John McCain and Socialist Workers candidate Roger Calero, also are not natural-born citizens and thus ineligible to be president.

At least one other appeal over Obama's citizenship remains at the court. Philip J. Berg of Lafayette Hill, Pa., argues that Obama was born in Kenya, not Hawaii as Obama says and the Hawaii secretary of state has confirmed. Berg says Obama also may be a citizen of Indonesia, where he lived as a boy. Federal courts in Pennsylvania have dismissed Berg's lawsuit.

    Interesting title, I guess those concerned about upholding the constitution are idiots.

    I'd be fine if it was proven that Obama is natural born. If and when that point is proven, then this idiot will shut up about it.

    I don't see a date for your article, but as of Friday "was initially denied a hearing by Supreme Court Justice David H. Souter, but Justice Clarence Thomas agreed to bring it back for review today."

    Furthermore, the case by Berg is still pending.

    I can't believe people are still beating that dead horse. The horse is not just dead, it has decomposed. Get over it. He is going to be the President on January 20 and that's all there is to it.

    At least this guy had a different take on it, not saying that Obama wasn't born her, but that by not having two US citizens as parents, that he was not a naturally born citizen. He was trying in interpret/clarify what the Constitution meant.

    Now for Berg and the other wingnuts who are still saying that he wasn't born in Hawaii, they should just keep stocking up on tinfoil.
