The 5th Circuit Appeals Court gave a hugh victory to insurance companies by denying Katrina victims any right to recover insurance claims due to the claim that the flooding was an unforeseen act of God (wind and water); and, the levees were a man-made event too ambiguous under their policies which would have cost the insurance companies over 1 billion dollars.
Did this ruling just laid the foundation for denial of insurance claims due to the flooding caused by Erin's (wind and water). Really a topical storm in mid America, totally an unforeseen act of God. So would all resulting damages attributed to Erin be subjected to this ruling?
