What a fucking disgrace of our judicial system, our government, and the assholes that found her not guilty by reason of insanity.

Obviously she was insane...and no fucking disease in the world should give you a free pass to a cushy mental hospital (with a chance to get out!) if you murder your kids!

Canada is looking better and better every day.

Jury: Yates not guilty by reason of insanity
Mother sentenced to mental hospital in drowning deaths of five children

HOUSTON - Andrea Yates was found not guilty by reason of insanity Wednesday in the bathtub drownings of her young children.

The 42-year-old will be committed to a state mental hospital, with periodic hearings before a judge to determine whether she should be released. If convicted of murder, she would have faced life in prison.

Yates’ attorneys never disputed that she drowned 6-month-old Mary, 2-year-old Luke, 3-year-old Paul, 5-year-old John and 7-year-old Noah in their Houston-area home in June 2001. But they said she suffered from severe postpartum psychosis and, in a delusional state, believed Satan was inside her and was trying to save them from hell.

Yates stared wide-eyed as the verdict was read. She then bowed her head and wept quietly.

The jury, split evenly men to women, had deliberated for about 12 hours over three days before finding Yates not guilty by reason of insanity. The jurors had not been told that she would be committed to a mental institution for treatment if found not guilty.

Prosecutors had maintained that Yates failed to meet the state’s definition of insanity: that a severe mental illness prevents someone who is committing a crime from knowing that it is wrong.

An earlier jury had found Yates guilty of murder in her children’s deaths, but that verdict was overturned on appeal because erroneous testimony. Prosecutors retried her on the same three counts of murder.

Ummm.. if a person is insane it is not only in their best interest, but in society’s best interest that they get the help they need. Take a deep breath and calm down.

The stigma of mental illness certainly is strong. The implication that Canada fries their mentally ill is a little hard to take though.

Yeah, mostly we just leave them as homeless people in our downtown cores.

We do the same thing here. The only time a mentally ill person makes the news, he/she has used a firearm or a machette. Awful. There is such a thing as recovery. Due to proper meds, those once thought insane can lead productive lives. I've seen it and it's cool.

A "cushy" mental hospital? I take it you have never been inside a mental hospital.

Having personally overcome bi-polar disorder and obsessive-compulsive disorder, I agree 100%. Not only can "we" learn to live productive lives, but given the right support and resources, we can overcome the illness aspects of our brain functioning, and come to live whole, recovered and integrated. It is VERY cool! :)

Those are hard to overcome. Congratulations. I'm recoverING (I prefer that to recovery because recovery is a constant evolution) myself and it is cool and hard but worth it. It's better to light a candle than to curse the darkness. Let's keep those candles going.

Yes, cushy and mental hospital should never be used together in a sentence. My work involves "visiting" mental hospitals and I hate it. Done time in them as well and cushy is not the word I would use to describe my stays. I swear I'll never go back again, but sometimes you're the only visitor, so you go.

Some are better than others ... with the best, of course, available only to those who admit themselves and are able to afford them. Yates will be in the state hospital, which is anything but cushy.

Great for you! I love to hear of the wonderful recovery processes! :) And here's to keeping the candles going, my friend!

I tell people I'm "enlightening" (;)) because I'm coming into more and more of the inner light of inSight all the time.

I still have sensitivities to my surroundings and having released enough inner issues I've become clarified to my gifts of sensitivity, and yet it is certainly an ongoing process of growing and releasing.

    Best wishes to you! :)

I couldn't agree more. The biggest problem with the Dept. of Corrections is that it's not about corrections at all. It's about punishment. I look forward to a day when we have a true correctional system rather than punitive.

Throwing someone in prison for life or even executing someone adds nothing at all to society. It in fact makes society even worse, IMO. It's quite clear to me that someone who kills her own children needs help. An eye for an eye will leave the entire world blind.....something like that.

State mental hospitals are awful. I walk in and immediately think of shock treatments and insulin injections and hot baths. But we do need state mental hospitals for the Yateses of the world. In PA, we are closing them, but NOT THE FORENSICS WINGS.

Oh to have money and be "insane"!

LOL...you people are all insane. Are you aware of the story behind this? She systematically drowned each of her 5 children in the same bathtub, one after another.

Come on...you people are kidding me, aren't you?

The fact is that insane or not, those responsible for acts as cruel as this deserves no second chance.

Fuck her and fuck you all who defend her or any other sickos like her.

There has to be a distinction between insane and criminally insane. Truely insane people who didn't commit acts nearly as heinous as this might have a case to be rehabilitated. But truely criminally insane people who physically harm others should NOT have a second chance.

We've got too many people on this sick Earth as it is. Why in the fuck would I want to give them another chance.

    "Fuck you very much."

It took her close to forty years, five kids and a blind husband, but they came to the conclusion that she is retarded and not a murderer. Yeah!!!!!!!!!!

Anyone who would drown their kids one by one is the very definition of “insane”, and so are you. I hope both of you get the help you need.

Way to go with the insults there, what are you 12? I have not read anyone defending what she did. We just feel she needs help. No one is suggesting she be let go free. Geeze.

You hit that right on the head! You are not only a self described "recovering" mental case yourself, but you and all you other Yates supporters are so ignorant to the world around you that you're blinded to the horrors and atrocities that these "insane" "non-criminals" commit.

I do wish you well in your recovery if you're mental condition was only self harming, but if not...well...you know what I think about you already.

You hurt kids...insane or not...you are a worthless piece of trash.

When you use abusive language with others, that's about your own anger.

You sense anger Suffragette? Damn you're quick.

As for you Bryan Combs...I give as good as I take.

What good will "helping" her do if you feel she shouldn't be let free? But you know what...if you want to pony up your personal funds to pay for a quack or extensive meds until she dies a peaceful death in her cot, you go on fighting that very "worthy" cause.

Make that the 100th floor. I don't believe I mentioned that I was recovering from something--as you so sagely put it--MENTAL.

Perhaps you protest too much? Get thee to a shrink pretty fast buddy before you really hurt someone besides yourself.

Fuck Santa and the sleigh he rode in on. It figures that you mentals and holy rollers still believe in him, as well as the power/right to rehabilitate maniacs. :)

Okay...even I'm depressing myself now. I love you Santa...I love you Easter Bunny...I love you God. ;) For the record I'm not the Devil you all think I am. I was brought up Catholic but I would consider myself Agnostic now.

I just get easily pissed at lunatics like this and the people that want to rehab them. She should at the very least be forever incarcerated. If you disagree with that...I pity you.

    Thank you very much.

I like dropping f-bombs by the way..

Most of Michigan's state hospitals were closed down years ago. I don't even think there are any still open, but if there are, they are horrific.
Even the ones you pay to stay are bad!!! To my horror, I found out they still do electroshock treatment in them...egad! Luckily, I have a seizure disorder, so I didn't get on the list for electroshock. :)
If any one thinks she is getting off easy...go spend even a week in a mental ward. Go to the best one you can find...and trust me...it is bad.

At the point they will release her...I may have other thoughts. While I do believe she was insane when she killed her kids, I question whether she should ever be out.
No one can force her to take her medication if they release her..and she will be proned to commit other henious acts.
I just don't know if she should get out ever.
    Save room for dessert!
