Am I ripping off Pearl Jam?

Ok so I started writing this song on my acoustic guitar. I wanted to base it on Untitled (the Pearl Jam song). It has the same finger positions in one part but it has been capoed at the 3rd fret. Picking pattern is not the same as Untitled but it remotely sounds like it. It's a really simple but beautiful piece and just dont want to be ripping PJ off too much. Ill do the tab for better understanding.

PS I don't know heaps about music I just picked up the guitar 2 years ago and taught myself eveything I know.

Capo 3 fret. Fret numbers are relative to capo
