Trump - 25th Amendment Solution

So, what’s Article 4 to the 25th Amendment? In the abstract, the amendment itself is about presidential succession, and includes language about the power of the office when a president is incapacitated. But Digby recently highlighted the specific text of growing relevance:
“Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.”
And what does that mean exactly?

Well, it means Congress isn’t the only institution that can remove a president from office between elections. Under the 25th Amendment, a sitting vice president and a majority of the executive branch’s cabinet could, on their own, agree to transfer power out of the hands of a sitting president. At that point, those officials would notify Congress, and the vice president would assume the office as the acting president.

And what if the challenged president wasn’t on board with the plan to remove him/her from the office? As Vox recently explained, “If the president wants to dispute this move, he can, but then it would be up to Congress to settle the matter with a vote. A two-thirds majority in both houses would be necessary to keep the vice president in charge. If that threshold isn’t reached, the president would regain his powers.”

    Two things wrong with this scenario.
    One, my understanding is this doesn't remove the president from office. It grants the VP presidential powers, but doesn't make him president. This is designed if the president was incapacitated or unable to fulfill the duties of his office, and not that people just don't like him.
    If I am wrong above, then you still have to go through congress anyway. The article talks about this being a way to remove him from office without congress, but then goes on to say if the president doesn't agree then it requires a 2/3 congress majority. So in essence, still need a congress vote unless you expect him to resign.

    Yes. But this wouldn't remove him from office but just give power to the VP, and unless he said "you're right, I'm unfit to lead" it would still require a 2/3 congress vote. Which my point was the article referenced this as a way to get rid of him without going through congress, and that isn't true. Unless he goes along with it, you still need 2/3 of congress.

    I don't think people are saying he's mentally unfit because of policy decisions. Most of those just make him an unimaginable asshole. It's because of his completely insane behaviour, separate from his policy decisions. The guy is barely even coherent half the time when he speaks, and the tweets, that bizarre scene when he walked out on signing an executive order, his even more bizarre behaviour with the German chancellor, all the vacation he takes and apparent inability to work as much as a president needs to, his apparent paranoia and compulsive behaviour, his sexual attraction to his daughter, his Goebbels tactics in terms of demonizing real news and advocating for fake news, the way he seems totally unaware of things he himself has said a lot of the time, how he has to move the job to his own properties, as though he can't handle the White House mentally, and the list goes on and on and on and on. He really doesn't come off as a mental stable person at all. Experts seem to agree.

    As for the idea that people are sadly shocked he's accomplished so much.... I think you're misinterpreting the sentiment, lol. I think people are sadly shocked just at the callous disregard for people's welfare that is shown in his executive orders, not by the fact that he sat his ass down in a chair and signed something in front of the cameras. It's pretty clear that it's not hard to sign executive orders if you can spin 40 of them out in a matter of weeks, lol. It's what those order DO that matters, and with Trump, that is not going well at all. I think that's why people seem dismayed. Interesting that some see irresponsible recklessness as being impressive though.

    Signing an executive order eliminating EPA rules and regulations are not going to bring coal industry jobs back, but for one example. Sure, 28 mostly empty campaign promises that, in the end, will fail because their wrong, misguided or unpopular or a combination of all three. Let me know when more Americans have health insurance for less cost and Mexico pays for the wall, will ya?

    I would be willing to bet that Pence has extreme doubts about Trump. We don't see what is really going on behind the scenes....my guess is that it is a nightmare.
