No, it isn't. That's not how any of this works.

As long the venue has BMI and ASCAP licenses, he can play any song (by any artist) in their catalogs. No further permission is necessary.

Same goes for PJ Radio. Assuming Sirius has BMI and ASCAP licenses for their stations (and they do), their stations can play any songs in those catalogs. That's why radio stations were able to play "illegal" PJ bootlegs over the air without getting sued - they didn't need permission. (Essentially, they already had it.)

The issue is RELEASING covers. For that, artists must obtain mechanical licenses from the rights owner (usually the songwriter(s)). However, these licenses are compulsory - the rights owner has to give them, so long as the artist requesting the license adheres to the statute.

When you hear about permissions being denied for covers, it usually has nothing to do with the artist actually needing permission. The statutory rates of compulsory licenses are generally unfavorable - major labels generally won't permit their artists to release a cover if the rights owner refuses to negotiate a more favorable rate. (The statutory details are also generally unfavorable for the rights owner as well, so they usually negotiate. But you occasionally end up with someone like Prince, who knows that he can generally block covers of his songs by refusing to negotiate.)

Long story long, Ed can play anything* he wants at this show, and Sirius can air it unaltered, so long as the venue and Sirius have up-to-date licenses.

(* There are a few things he theoretically couldn't play. For example, he can't play unreleased songs by other artists without their permission. But anything released and published is fair game.)

I am still in the dark from the Hurricane Sandy - Day 6. Due to the shortage of gas, we have been using the gas very carefully. I do not think I can run the generator only for this while I am telling everyone to conserve and made my husband to turn off the heat switch

Can someone please work out for me what timeday this will be Australian time- Victoria (daylight savings time) & I'm hearing conflicting stories as to whether it will be on PJ Radio and Sirius or just Sirius. Would someone mind clarifying

I am looking for some kind soul who will have a decent quality recording after it happens. I don't have Sirius and while I know there is the free online trial thing, I just can't bring myself to listen to a live Vedder concert on the Internet two nights before I finally get to go to a live Vedder concert in person. I hope that makes sense. I feel it would somehow spoil the live experience being so close together, after finally waiting for this long to see a solo show in person.

I am even going to avoid looking at the AZ setlist if I can.... I don't want to know what was played at the prior nights show to have something to compare it to. it's going to be hard but I hope I can do it.

Anyway, when the dust settles, please let me know if you have a recording of it. I'd le to listen repeatedly to a radio quality solo concert in it's entirety, just starting on Wednesday.

I don't know if this helps with the time zone, exactly, but on my world clock on my iphone right now, it's 10:06pm on Saturday in California and it's 4:06pm on Sunday in Sydney, so start doing your calculations.
