Explain this...

This has been bothering me for a while now.
I bought an album on iTunes a while back when they still had DRM protection (several actually).
They've been offering upgrades for a while which will give you the music at a better bit-rate and no DRM.
So for instance:
I bought The Cult "Electric" for $9.99 a few years ago. Lower bit-rate, with DRM.
I can "upgrade" for $3.00.
This makes the total purchase price for that album $13.00.
BUT... Anybody else who buys the album today, gets the better bit-rate and no DRM for $9.99
WTF?
