Is there anything illegal with selling this recording? Couldn't they simply say they're charging for the disk and time?

It's against eBay policy for one. It's against Pearl Jam policy regarding taper boots as well. I'm sure the performance is copywritten by CBS and/or the band.

That's jacked up as well, but not really against band/eBay policy. He bought the items and has a right to sell them. However, the guy selling this boot did not buy the performance. He downloaded it for free and is now trying to profit off of it.
