During their appeal, FOX asserted that there are no written rules against distorting news in the media. They argued that, under the First Amendment, broadcasters have the right to lie or deliberately distort news reports on public airwaves. Fox attorneys did not dispute Akre’s claim that they pressured her to broadcast a false story, they simply maintained that it was their right to do so. After the appeal verdict WTVT general manager Bob Linger commented, “It’s vindication for WTVT, and we’re very pleased… It’s the case we’ve been making for two years. She never had a legal claim.”


so this was interesting. Any thoughts? I am not sure why I hadn't seen this before.

    I live in another country, so I have no saying here... however, it's nice to know that to the media lie is ok... when will libel and slander be ok then? If the media have the right to lie or deliberately distort news reports on public airwaves about facts, why wouldn't they have the right to do so with people?

    That is what I was wondering. I am surprised that this didn't go further than an appellate court in Florida.

    Right, I think we all knew it happened. Especially in shows that are opinion based. But this seems to eqaute opinion shows with the nightly news. One I understand saying whatever the hell you want, anyone can have an opinion, but falsely reporting the news seems like a different offense all together. If the media can openly lie, distort facts, and report what it wants without impunity...than what chance does the world have? What chance do we honestly have in believing anything. I read about this case for a different reason, but it applies to the Martin / Zimmerman non-sense in Florida as well. Apparently the FCC has no real power over ensuring truth on the airwaves...So i ask, as did Hedonist, what good is the FCC? what is the point in having a regulatory agency that spends more than 300 millions dollars a year that really can't do anything except fine people for saying shit before 9:00 and make sure wireless devices play nice...

    $300 million dollars well spent in my opinion.

    we see a disclaimer for television that some might find offensive...with all their regulations, why do we not here before the nightly news the same disclaimer played for every infomercial on Saturday mornings...Are you telling me that our media isn't held to the same standard of truth as Ron Popeil?

    dude ... it is why i have been saying the biggest problem in america is the corporatization of gov't ... the FCC, EPA, etc ... they are puppet organizations to suit whatever interests (mostly corporations) they are beholden to .. it's why so many of these so called federal agencies are headed by former people in industry ...

    it's been like this for a long time and many of us have been saying this ... the gov't is not there for the people ... it's for whatever agenda the corporations and sometimes religous folk want to push ...

    Everything in the media has its hands tied, and that probably goes for the FCC too. Like unions, the FCC had a place in society and it worked effectively. But since true journalism isn't around anymore with the rise of individually owned corporate media (think Rupert Murdoch owning much of the airwaves), truth getting reported along mainstream news is a complete joke nowadays.

    thanks for the comment, as I said, since I live in other country, I haven't seen or read this, however, I wouldn't be surprised if this happened, it happens everywere, but that they admit it without remorse and believing this is correct is quite shocking!!!

    let's see what Bill Maher have to say about this next Friday (yes, I watch Bill Maher show on HBO, live, about 2 am on Saturdays)
