So funny. Deciding if a law is constitutional is being an activist judge according to Obama.

Also funny - he doesn't allude to Kagan trying to parse the law. Which is actually activist.

    I don't understand the precedent that has been set that supports this? i don't get it.

    It is strange what some call activist judges...A different interpretation of the law isn't necessarily activism. I guess it is inline with what many supports of judicial activism believe...that the court should simply uphold it because it was passed by a democratically elected congress? that is nonsense and he knows it. That is the worst reasoning I have ever heard for finding a law constitutional.

    I thought 'Acitvist Judge' was a term for a judgement that went against the way you thought it should have gone.
    Because, that seems to be the most popular use of the term... a ruling goes against your beliefs, it must be because of an 'Activist Judge'.

    Yeah. It's so silly. He's still arguing his case. He's also forgetting basic Poli Sci 101. Separation of Powers. It's a beautiful thing. He's such a buffoon. Do people still think this is an intelligent man and not a used car salesman?

    I don't agree with a lot of obama's policies. But you have to have a lot of ignorance to try and suggest that Obama is unintelligent.

    Well, if he cant pass high school social studies and thinks the Supreme Court determining Constitutional Law by actually READING the law Congress didn't and hearing argument from his advocate is being activisit instead of doing the job the Constitution clearly requires of them, then yes, I would consider his intelligence level low.

    Funny how folks brand GWB stupid because he doesn't speak like a Northeasterner, and that's ok. At least he knew that your legislature should read bills before turnining them into law.....

    Whereas if this man believes what he spews, he is stupid. And if he doesn't believe what he says, well, then he also lacks integrity. Neither is very attractive in a person folks plan to reelect as the "lesser of 2 evils."
