After trying to trade my copy of PJ20 on vinyl with no success, I had to put in on eBay (tuition is a bitch). Long story short, I sold him my copy, he got it and then sent me this.
"Hello,I received my PJ20 lp today and was very disappointed to see that the perforation is torn open on two different corners.I am not happy with my purchase, because the listing states the condition as "new", which is described as "brand new, unused, unopened, undamaged item". You also state that it is "sealed" in the listing title, so I was expecting it in that exact condition. There is no mention of the tears in your listing.These do not appear to be fresh tears & maybe you didn't notice them or thought they were too insignificant to mention. One tear is 1/2" and the other is 3/4". Please tell me how to proceed as this record is not in the condition I was expecting & I would like to kindly request a full refund and I will return to you for resale. Thank you..."
Seems super lame, but I was inclined to give him the benefit of the doubt. Then I looked and saw that he's flipping tons of copies of this. Now it all seems fishy to me. Anyone know who this guy is and can vouche for him?

Whatever. Whats the big deal? Sell it to someone else. A fan. The customer is right though. He wasn't happy with the quality so give him his refund. Thats business my freind. Unless your just as shady as him.0 -
He wants to return it because the seal is broken. If you listed the item as "sealed", and it got to him in unsealed condition, then he has a complaint.
He obviously wants it to be sealed so that he can turn around and sell it to someone else for more $$$$And so you see, I have come to doubt

It's still sealed. Never opened, never played. Definition of "seal": A closure, as on a package, used to prove that the contents have not been tampered with.
You know what, in retrospect, he's probably right, the record has definitely been tampered with through those little breaks in the perforation that weren't there when I mailed the package.
If he was concerned about whatever hairline fracture in the perforation that may or may not have existed (it didn't), he should have asked.
We can debate the merits of his complaint all day, or someone can vouch for this guy like I asked.0 -

Were those tears there before? I noticed those bags tend to come torn already so it seems like he's being anal. It is annoying but I guess if it wasn't disclosed, I can't really see an argument for you to challenge him on this.
However, it does sound a bit fishy to me, I mean, I wouldn't have complained about something like that, just because I've seen how these vinyls come. My 10C one came dinged in one corner, and a spare from somewhere else came with the inner sleeves torn. To be honest I almost sold that to someone here thinking it was in perfect condition but I looked at it closely because I'm paranoid about issues like this and to my horror saw the inner sleeves ripped.
I say give him a full refund and have him send it back and be clear you are expecting the same one back and not some replacement crap. Yeah, it's not ideal and you're gonna have to attempt to sell this all over again, but I would pick that over having to interact with someone you don't trust anymore.
If you want to battle it out, then just say politely that you disagree and as disclosed in your posting, all sales are final and you are sorry he is not happy with his product. He will probably give you a negative rating, might try to report you to eBay and if you want to put up with all that then by all means go for it.
As for trying to sell it again, I'm 99.9% sure that if you sell it for what you paid, someone will pick it up, unless you are trying to make a profit. Not suggesting you were (I didn't see your original post), but I think people are still looking for this and just don't want to pay ridiculous prices on eBay.

I've already spoken with someone else who has a similar story from this guy, and when they accepted the return a badly damaged copy came back, significantly different than the one that was sold to the user. This guy is buying copies to flip, and when he gets one in a condition he doesn't like, he swaps it out like he's trying to do here.
I have pictures and insurance on the record. Bring on the PayPal battle.
I suggest other board members stay away from this guy.0 -

Pretty much sounds like you are screwed. THe guy can file a complaint with PayPal and get all his money back and you are going to be screwed into either losing the album and money or you're going to be out of the money and stuck with a shit copy.

This is just getting comical now. Buyer states, and I quote:
"Is the item open? Yes, on two corners. Is the item sealed as stated? No. Perforation is not specifically mentioned, but using the term "sealed" is saying the same thing, is it not? It's either completely sealed or not."
So essentially, the use of the word sealed cannot not be used at all in these circumstances. When an item is not completely sealed (I still maintain it was), it is now open. Yet, a quick peak of the three versions of the same LP he currently has up on eBay mentions the words sealed all over each auction, but then he qualifies it with descriptions of breaks in the perforation. So it's okay to say somethings new and sealed, and then say its not because its opened, but still call it new and sealed. That's like saying a car is in new condition, and then saying it has dents all over it. You can still call it new when you point out the dents.
This guy is up to no good. I have copies of all his emails and PDFs of all his auctions where he uses the same "sealed" language to describe his items that aren't sealed by his definition he is trying to use now to claim the item he received was not as described. Looking forward to this PayPal battle.0 -
