Individuals who knowingly bring frivolous and vexatious lawsuits against another party should not only have to pay costs for the opposing party; they should also be required to pay the costs incurred by the court. That means the salaries of the bailiff, the court reporter, the judge and any other parties involved and an additional penalty for wasting the court's time.
People complain about welfare recipients, yet this jerk and his kids is costing taxpayers a small fortune and backlogging the court.
The judge in a case, or the jury depending, should be able to impose a fine. the only problem with that is that the fine becomes subjective and may be seen as a barrier to filing a legitimate case by people who could not pay that fine if the lose and the judge is feeling like it was frivolous. Then there would have to be an appeals process for the fine...all in all it might be just that we have to take the good with the bad with out justice system. What about imposing a healthy fine on the law firms that choose to file the case?...still subjective, but I would certainly feel better than charging some misinformed dope on the street. A person may be an idiot, but a lawyer should know better.

The only problem with passing this directly onto a firm is that fees will be adjusted across the board to allow for more frivolous lawsuits. Hourly billing will include an undetermined dollar amount to cover the cost of frivolous cases. I still feel that responsibility rests with the plaintiff. Remember, the dope on the street can always sue his or her lawyer if the case is found to be frivolous.
