PJ YouTube covers copyright - Music Publishing Rights

I have covered quite a lot of Pearl Jam songs for my own enjoyment and put them on YouTube and have had no problem until my latest.

It says:

"Your video, I Am Mine - Pearl Jam acoustic cover , may include content that is owned or administered by these entities:
Entity: Music Publishing Rights Collecting Society Content Type: Musical Composition"

You can dispute it with the following reasons:

" 1. This video does not feature the third-party copyrighted material at issue. My video was misidentified as containing this material.
2. This video uses copyrighted material in a manner that does not require approval of the copyright holder. It is a fair use under copyright law.
Please explain briefly:

I'm not too clued up on the law, but there are so many covers out there of all bands and YouTube hasn't seemed to have stopped them in the past. Maybe it is a new thing.

Pearl Jam, being Pearl Jam, Im pretty sure they would let other people cover their songs. I've even heard Eddie say he has enjoyed watching people cover them.

I want to dispute it, but dont know where I stand on option 1 or 2.

Can anyone help?

    hmm really strange. I always thought that copyright laws worked like citing a reference in a paper. It's fine as long as you give the author or artist(s) credit. You weren't using the cover for profit, just to share and enjoy with others. I figured as long as you weren't professonally recording an artists song you didn't need anything more than to aknowlege the original artist.

    Copyright laws are so broad and there are always loopholes it seems. Remember they cut RITFW from PJ unplugged, but yet, the song is on all the other officially released bootlegs from shows that we bought on the website.

    All just speculation on my part but as far as I know, songs can be performed non profitly for free as long as the original artist is given credit and it is not being used for profitable gain.

    I would dispute it, like I said, so much red tape to jump through.

    seems like you have a good dispute with reason #2 from what I have mentioned above. Pure speculation on my part, but I'd go ahead and dispute it with reason 2.

    You could just take it down off of YouTube, especially if there are no issues with your other posts. If you have the same issue with your other clips, then you could not post them on YouTube anymore. The world will continue to spin without your cover of I Am Mine. Just sayin'.
  • I've done a fair amount of reading on it tonight and it looks like it boils down to the artists permission. I reckon it is probably Sony's decision rather than the band.

    The clip is still up, it just has adverts all over it. From what I gather it will stay up, it's just strange it is the first time it has happened to me. Maybe it's because I tend to avoid the high profile songs. Anyway, I think Sony are probably getting some cash from it which is all they want.

    I think I'm gonna leave it rather than contest it and see what happens, particularly when I get round to doing another one.

    You are right,there are quite a few I Am Mine's out there :D Riot Act is my favourite album so I am intending to do it all.......if Sony let me :D

    I googled the tread title, and several discussions popped up, as those things happen all over You Tube:

    It seems that one get tracked though random Content ID program, gets information about that, and that's it. Not really copyright issue.

    you don't need to worry about the videos or your channel getting removed if you get this warning. however, if you get a claim from, say, Sony then your account will be in jeopardy.
