I don't care if your a liberal Democrat, a Libertaian, a Republican,conservative or an Independent. If this doesn't concern you or get your attention nothing will. What do you think this woman will do when the EPA'S over reach on the delegation of authority and the Individual mandate under the Gov run Healthcare bill reaches the Supreme court ?

So here we have a Supreme court Nominee when asked by a senator if that the gov has the power to dictate what we can and cannot eat if that is Un-Constituional,and she wont answer the question.

Here she was also in front of the supreme court supporting a law that empowers the gov to ban books. Under certain circumstances. Although she believes the current gov would do so. Yeah sure :roll: They already tried in the citizens united case.

    I think the basic question was rather silly in general, I would have liked to see her answer to his follow up, or clarification as it were, to how far she would think the commerce clause can be taken. It doesn't seem to me like she would support a law like that, but I think the important part of her answer was that judges should not strike down laws simply because they think they are dumb. It holds pretty close to what I would expect a judge to say. Not to ajudicate based on feelings, but rather based on the gov'ts express/implied power . Based on previous posts I would think you would support that type of bench behavior.

    I didn't watch the first video, but as far as the book banning thing, that hearing was while she was Solicitor General... so she was basically arguing a case for a client. You can't really hold a lawyer's comments against them (or as part of their philosophy) when they are making the cooments as a lawyer arguing a case on someone's behalf.

    for most people these hearings are only a formality. i'm sure that if sen franken did not already know how he was going to vote he would have been riveted to the exciting testimony. that said, come on man, drink some coffee or something. as a senator isn't this why you have assistants?

    I didn't see him sleeping, but I did see him tear his Republican colleagues a new one in his final round. He took them apart on judicial activism, on Marshall's record, and pretty much every other topic he touched on. He was straight forward and eloquent, and at times blessedly funny (a blessing since these hearings are in general deadly boring).

    You can thank Chief Justice Roberts for the evasions witnessed during every Supreme Court confirmation hearing since he set this precedent.
