Anyone Familiar With UK Employment Law?

I have a job that I've been waiting to start. I emailed HR today about my references, particiularly to see if they had any luck with the final one. This is what I received:
I have managed to get in touch with *shit housing association I worked for until October 2007*. Unfortunately SHA merged with C&C in January 2009, and anyone who left before the merge, they would have not received their personal details.

How can this bloody organisation not have my details of employment on record? Is there anything I can do or are they really under no legal obligation to retain them? I'm so bloody frustrated by this.
