Pearl Jam frontman Eddie Vedder may have sung "gibberish" when he covered an obscure Canadian musician's only hit, but the changed words probably don't amount to copyright infringement, a judge said yesterday.
Manhattan federal Judge Richard Sullivan said prior cases "appear to allow a lot more change than occurred" to "Hard Sun" by Gordon Peterson, who's suing Vedder for altering the lyrics.

I hadn't even heard of the guy before Into The Wild and actually gave his version a listen and enjoyed it. I'm sure Ed's effort has been nothing but positive for this guys exposure, and this is his thanks?

Hard Sun was a massive hit in Canada in 1989 - HUGE - played on the radio and video on MMM ALL the time... And, to myself and a bunch of my friends, Ed's lyric changes were VERY obvious...I still really liked the Ed version, but I kinda thought that Gordon Peterson (Indio) would not have been amused - and actually wondered how they got permission from him considering nobody knew where he was.... I also think that as an artist, Ed understands all about musical integrity...and that this was not a cash grab or a ploy to get attention...The song has not received any significant increase airplay because of this...and Indio's album is no longer available...

i wonder what ever happened with radiohead and satriani? i know there was an out of court settlement but...

its not ed's/pj's first time being sued. or his last.
and anyone who sues because someone else changed a few lyrics when they sang a cover is an absolute douche. i would never do that.
I am sure Ed got the okay to use the song before he even went forward with it. Just my thoughts.
