Hopefully the delay is due to something special, packaging wise maybe........The fan recorded versions can only hold a brotha for so long!!

we wait as we did for Europe ones"...Dimitri...He talks to me...'.."The Ghost of Greece..".

First, although I read a lot, I don't post much because it's just not my style so I hope no one takes offense...
I too have been looking a couple of times a day bc of all of the shows I've been to (about 20 now), I have never so anxiously awaited the boot and I've been puzzling about it too esp. since the Aussie boots are up but I had a thought. Although you can play a song live without trouble with licensing, when you package it and sell it, it's a different story, particularly if you are making any profit from it. PJ played "Whip It" at the Halloween show for the first time, and so I am wondering if maybe they are having licensing problems with Devo or whomever is the manager of Devo's licensing. Just a thought this attorney (although not an entertainment law atty) had. This would only explain that show, but maybe they want to release them all at the same time?
And for the record, I am really hoping this isn't the case and it's the totally awesome packaging/vinyl/4show set that's causing the delay. 0 0

I'm getting pretty fucking sick of waiting. At least the Europeans had radio broadcasts to tide them over.0

That, i think, is a good point. :problem: Hopefully this is not the case.Evolution Music Studios presents:

Licensing would not be the issues with Devo's whip it. You can "cover" a song all you want after it has been 7 or more years since the song was originally recorded. You also must license a song if you sample it. Obviouslly there are no samples here, so my felow PJ fans i belive we have clearance.
My guess is a Gorge type package and hopefully with a DVD0

Yeah, special packaging would be sweet--a DVD would ROCK... still.. in time for Christmas?
Pretty please with sugar on top?

I was guessing some kind of package as well or at least hoping, definitely cool with waiting especially if there is a dvd involved.0

Unfortunately, it's way more complicated than 7 years. The key is whether you are making a profit.
Different bands have different licensing rules and the licensing can be sold and bought and extend well beyond the initial period. In terms of the copywrite law, music Created 1978 or later (whether or not published) is protected until the life of the author(s) plus 70 years (17 USC sec. 303(b).)
That's a bunch of legalese and like I said, I don't know if it's the reason there is a delay, but if you look on iTunes, it seems there is no cover of Whip it that wasn't recorded by some variation of Devo. That's why there are bands from ages ago that you still can't cover for profit, or at least, who can't be covered for any reasonable amount of money.
 just my thoughts...0

Thanks for the quick research! Good work. So again...it may be a problem...
...Hey just found this from Mark Mothersbaugh, Devo founder...
"On Pearl Jam’s live cover of “Whip It” on Halloween: “I haven’t seen it yet. About six months ago I had dinner with a couple of the guys, and we talked about doing a Christmas ‘45,’ because I guess they do one every year.
They said, ‘Hey, what if we put a Pearl Jam Christmas song on one side and a Devo Christmas song on the other side?’ I don’t know. I’m scared of the Nativity, so I’ve kind of pushed it out of my mind. But who knows, maybe next year for Halloween, Devo will go as Pearl Jam.”Evolution Music Studios presents:

They have played covers numerous times and sold the boots for profit. They aren't selling the song, it's the show.Member 164xxx
