this is the girl who was gang rapped and locked in a shipping container....David Vitter is 1 of 3o senators who voted against a bill to deny defense contracts to companies that deny rape victims the right to seek redress in a court of law.

    i'm pleasantly surprised that neither ohio senator is on that list. for the party that claims to be about life and values and family, they seem awfully reluctant to let petty things like human and constitutional rights get in the way of the holy sanctity of a private for-profit contract designed to exploit workers for capitalist gain.

    A woman was raped while an employee of a company, why wasn't law enforcement allowed to prosecute the case?

    And all I see about this bill is that it would prohibit companies who have these sort of policies from getting gov't contracts... shouldn't the bigger issue than gov't contracts be that these types of incidents should be prosecuted?

    This is bullshit. If someone is raped it's a fucking crime and someone should be in jail. It's not something you "arbitrate" behind closed doors. The corruption in our government on both sides is sickening, and these dirtbags who just sold their souls for the love of corporations should all experience what she went through and see if it should just be arbitrated.

    I'm almost certain it would still be considered US jurisdiction since it essentially happened on a US base.

    speaking as a guy that just passed the bar... i have no fucking clue. i'm sure my friend would, she's a legal genius about that sort of thing. my best guess is that as far as criminal charges go, they'd be subject to military law assuming it occurred on a base. if it happened in a private haliburton office... i'm not sure. perhaps that's why criminal charges were never filed... i cant imagine she'd have much luck pressing that issue in an iraqi court.

    but the issue here is that she wanted to file a civil lawsuit against haliburton for damages. but haliburton, as do most american companies, condition employment upon you basically waiving any legal rights you ever had against them and submitting to arbitration for all claims against the company. personally, i think such agreements should always be illegal in the employment context. it leads to things like... a woman that was gang raped being locked in isolation and interrogated by company men trying to cover their asses and then being handed hush money behind closed doors by your rapists so that they don't suffer any bad press.

    yeah, vitter also was the only person in government on the state or national level from louisiana that did NOT condemn the justice of the peace from the other thread for his discrimination. even governor jindall spoke out and called for the guy's resignation and said it took too long for the guy to resign. and jindall is just as big a tosser as vitter.
