A Neighbor Question

I have a tree that sits between my house and the neighbors

The tree is on my property

My neighbor came over Monday and was asking me if about trimming back because its getting close to his roof

My question is who pays for the tree to be trimmed up ?
My drinking team has a hockey problem

The ONLY thing better than a glass of beer is tea with Miss McGill

    i was think technically you would since you own it. but since he is asking, you can offer to go half and half on it. or you can tell him to fuck off. :lol:

    Yeah..I might ask him exaclty what he wants to do

    If it's not your legal responsibility but you want to be a nice guy, you can say "i don't really have money budgeted for it, but I'll pay for half of it, but you'd need to front that and I'll pay you monthly until I pay off my half" and that would make it sting less.

    I'm sure he felt awkward about it too...

    Check with your local laws about it. I take it to mean that your tree is too big to trim yourself?

    Yeah its pretty tall...I didn't really check it out to see if the branches he was complaining about were all the way at the top or not

    I had this same tree trimmed when I moved in about 2 years ago so it gets a little un-ruley

    We had a huge tree from our douchebag neighbor's yard fall into our yard. Taking out the fence and coming a a few inches from the house. His reply "it's on your property, it's your problem".

    as mentioned, different municipalities have different rules. definitely call to find out what holds true for your area. where i live, even if it's your tree, if i want it trimmed, i pay for it.

    we have 2 large trees that border our neighbors. one neighbor (who we despise due to many issues surrounding noise related to him basically running a mechanic shop out of his garage) asked our permission to trim off a very large branch of one of our trees (b/c they were building a humongous new garage for said business, that somehow our village approved and it would be in the way). we had their tree surgeon come over, explain exactly what was to be trimmed and also any ill effects, if any, might occur before we issued our written consent to access our property and trim the tree (and yes i realize since they hired him, he could well lie...but i still wanted someone to explain). funny too, our relations are so strained, he sent his wife over to ask b/c i think he knows if he came over, we'd tell him to go fuck himself. :P

    anyhoo....glad your relations are on GOOD terms, and definitely nice of you to offer to split costs. it's nice to realize not all neighbors are assholes. hell, most of our neighbors are great...but of course the biggest asshole has to live right next door. :x :evil: :x sorry for the rant. :mrgreen:

    It's your tree so it's your responsibility. If it's touching his house then you would need to cut the branches.

    You don't want it to be a liability for you later on.

    In all reality your neighbor can't really force you to do it without legal action, but it's probably not worth going there. I say, just do it...

  • it is your responsibility, if you do not cut it and it comes to damage his house, he could sue you for negligence and would most likely would collect for damages. Especially now that he was raised the subject to your attention.

    If it's your tree, you should pay to be a good neighbor.

    Now, you could be a dick and refuse to do anything about it. And in that case, your neighbor has every right to mutilate your tree on their side and there is nothing you can do about it as long as they are just taking care of what hangs over onto their property.
