Over the counter shit was neither illegal nor against MLB rules in 2003.

Ortiz has taken countless tests since and has never failed.

"I definitely was a little bit careless," Ortiz said Saturday. "I was buying supplements and vitamins over the counter ... but I never buy steroids or use steroids.

There is more to these tests, the players( i feel) knew they failed back then. MLB union tipped players off whenever they had a chance

From the way they did the test, only an idiot wouldn't realize he tested positive.

"In 2003, legally available nutritional supplements could trigger an initial 'positive' test under our program. To account for this, each 'test' conducted in 2003 actually consisted of a pair of collections -- the first was unannounced and random, the second was approximately seven days later, with the player advised to cease taking supplements during the interim. Under the 2003 program, a test could be initially reported as 'positive,' but not treated as such by the bargaining parties on account of the second test."

He set this defense up years ago, when he said something about "not knowing what's in a protein shake in the DR" I said it here on the board, probably in the RS thread. I'd go pull it up if it weren't near 300 pages long. He knew he failed, threw that out there to soften the inevitable blow, and have a "See, told ya there might have been something in that shake. Not steroids though, I never buy those" defense at the ready
