Texting should definitely be banned. Just talking while driving has been banned here, unless you are using a headset to keep your hands free to drive. Duh. Personally, I wish they'd say that if you want to talk, pull off the road, period. Police had not really done a whole lot to stop people from picking up the cell phone and calling for a while. Recently, they had a crackdown on a weekend and hundreds of people were cited and fined $100 for a first offense, $200 for a second and so on. I am 100% for this and fully support the police and my city for finally doing something more than talking about it.

Here in Australia it is illegal to talk whilst driving unless you are on hands free and I know plenty of people who have been pulled over and booked for talking whilst driving.
The thing is though, where do you draw the line? I think it takes a great deal of concentration to drink a cup of coffee without spilling it all over yourself while you are driving. It takes concentration to flick through the radio stations or songs on your ipod, it takes concentration to eat and do your make-up or hair etc etc
Technology will probably see the invention of a mobile phone that has an *incar* mode not dissimilar to the *inflight* mode, but tweaked to be used as hands free but with no txting or something to that effect. I don't know the answer, I just know I dont ever want my kids or anyone I love to be struck down by some wanker who thinks its more important to txt than watch the road.

No I'm not saying that at all. They will get a ticket and whatever they deserve for causing an accident. Should we ban eating while driving? How about smoking while driving? If someone rams you in the ass b/c they aren't paying attention, are you going to be more upset if the say they were trying to light up a smoke or if they say they were texting? Either way, you're going to be pissed, give them an earful, and sue their insurance company. What I'm saying is that there are plenty of more things our police can be focusing on then this.
I can see if an accident happens where someone is really injured or dies and there is a suspicion of texting, the police can maybe try to get your cell phone records, but just to pull you over for it? How do they prove that you were texting? Maybe I was just checking the time, maybe I was taking a shot on a tiger woods golf game or picking a song to listen to or checking directions on mapquest.... are those illegal to do while driving?
You'd almost have to outlaw any use of a phone while driving, but that gets you into another argument... is reading mapquest directions on a phone illegal, but reading them from a piece of paper or a map allowed? Is checking news headlines on CNN mobile illegal, but glancing at a newspaper front page that you just picked up legal?

Put another way, research shows texting while driving to be worse than driving drunk. So, if you're not going to ban texting while driving, you might as well legalize drunk driving.

Absolutely, it happens here all the time on the Beltway in the DC/MD area. I can even tell the texters, they hold up our already horrid traffic situation by sitting there for 10 seconds or more texting. The only thing that interrupts them is a loud horn several times. They weave in and out of lanes and you watch and see some form of road rage with a life being taken is going to come from texting while driving.
