From what I understand, since 2006 when 10,000 days came out, they have essentially played the same songs every single night. And from what I can tell, they have toured in 2006/2007/2008 and also in 2009.

I saw them on their small venue mini tour in 2006. They played The Pot and The Patient.
I saw them on their arena tour in 2006. They played Right In Two with an Intension teaser.
I saw them on their final tour of 2007. Jello Biafra of Dead Kennedys came out and they did Holiday In Cambodia.
I saw them twice on the Lateralus tour. I got to hear songs such as Opiate, Pushit, Undertow, and H, as well as the whole Lateralus album-Ticks and Leeches.
I've been pretty fortunate when it comes to Tool shows.
But just from an artist perspective, from a perspective of people who create art and make music that is meant to mean something to people (as opposed to sell music units like a Britney or Christina), that playing the same setlist night after night would be boring, and soul crushing.

After seeing these guys twice, I think their reasons for not changing the set would be more to do with the animations and visuals which accompany the music. I remember the first time I saw them they had live contortionists on stage, amazing visuals and the whole performance was like watching a piece at the theater. I think that's what they are setting out to do. Provide an art-style performance. They are at the complete opposite end of a band such as Pearl Jam when it comes to the live show. Pearl Jam skip the theatrics and go straight in for the rock experience meaning they can play whatever the hell they want. Just two very different styles I think. Both awesome for different reasons. (Although not many bands can do the 'Pearl Jam' and play whatever the hell they want and still leave punters satisfied).
The set the played for me at download festival in 06 was PERFECT!
Maybe its because they put a lot of work into the songs and they are extremely complex unlike pearl jam songs. And who would get bored of any of their setlists anyway, like i said complex!!! Okay.. maybe its lame if you saw every show on the tour, but then again thats just crazy :P

I'm with you here-- I can see them playing the same set night after night for an entire tour, but the last time they toured was years ago. Why not switch things up a bit this time? I would have went to one of these shows if I saw even one remote different setlist. They only changes to the set that they've made since last time is that they CUT a few songs out of the set. I think Maynard's too preoccupied making wine right now, so they're just playing what they know.
If you read the reviews of the shows over at toolshed.down.net, there are plenty of mentions of where the band screws up in their 10 song sets several times this little tour... Tool prides themselves on their ability to play the songs perfectly-- it's almost expected of them. They probably just decided to play a few shows and rehearse casually beforehand.
I will certainly catch them at least once on tour everytime they put a new album out, as the set will be different at least the first time around.

Over half of the tunes that they played each show were completely different from the night before and they would have a handfulla numbers they would swap and it would change from leg to leg. They would play for twice as long as almost any band now. I'm sure their light show wasn't as easy to run as any bands' today.
