first time home buyer credit ($4k individual)

my husband bought our house when he was single and my name is not on the mortgage; however my name is on the title.

do I qualify for the first time home buyer credit if I buy a house (something like a foreclosure) on my own or am i considered already a home owner since i'm on the title? you can't get the credit if you owned a home within the last 3 years.

    if it's meant to be a FIRST time home buyer credit, i would think you could never have owne a home before....? hahaha. that makes no sense.

    as to your query, i am thinking since your name is on the title, you are then considered an 'owner'...and therefore, disqualified from this credit. however, i also think it would be easy enough to call up any bank or mortgage broker and get s 100% accurate answer.

    I believe if your spouse has owned a home, you are both ineligible. I was hoping that Tim would qualify, but it appears I disqualify him :o
