    So I am confused as to why she was detained.  Did she impede the process of ICE?  If not and if she did ask for a lawyer multiple times and wasn't granted one then she should sue the pants off them.

    If you get in the officers way then yeah, you will get detained but they also shouldn't be over the top aggressive like that.

    She was detained though, not arrested.  Cops can detain you for just about anything and let you go. That I know. Like i can get detained for not having my drivers license and refuse to give my name.

    The idea of forcing Medicaid recipients to do that kind of work is beyond absurd... and he knows it.  It's trolling on a grand scale.  
    We haven't even begun to see the affect of forcing those hard working, highly capable workers out of the country.  
    Food prices are going to skyrocket.  If I had the energy and the right soil, I would have put in a large garden this year.  If I lived in a big city, I would start up or get involved in urban farming or a join a community garden or do rooftop gardening.  I'm just very lucky to live in an area that has a fair amount of small farms and a decent farmer's market.  
    Seriously, get busy, be prepared.  This is not going to get better overnight.

    Right. But sounds like she wasn’t questioned.
    What I meant when I said only if criminal charges are being sought was if you’re being questioned as a suspect. If you’re being questioned as a witness they won’t mirandize you. You still have a right to a lawyer if you want, but they won’t provide one.
    So the fact she was never questioned and only detained a few hours, there was no obligation to provide an attorney. It’s not like they have a room full of attorneys next door waiting in line, and as soon as she requests one he comes in.

    She was detained though, not arrested.  Cops can detain you for just about anything and let you go. That I know. Like i can get detained for not having my drivers license and refuse to give my name.  
    They need reasonable suspicion to detain someone, which has a lower threshold than probably cause.

    If a cop has reasonable suspicion that your are under the influence while driving but you don’t consent to a field sobriety test, they can detain you until they get a warrant or something.
    Now reasonable suspicion can be subjective and can argue it in almost any scenario.

    I never said you don’t have the right to one. In fact, I specifically said you always do. 
    I said they won’t have to provide one in some cases.

    No, he’ll just write you the ticket and move on. You can provide the attorney yourself when you fight it in court 3 months later.

    She was accused of assaulting an ice agent. They detained her for a few hours, decided not to press charges and released her. She was never questioned. Not unreasonable she wasn’t provided an attorney within that timeframe.

    Bigger question would be if there was reason to suspect she assaulted an agent. I’m sure there’s camera everywhere, if she came nowhere near to contacting any of them, then she has a case for that.

    ANYONE still think  they're just looking for criminals? I'm scared. 
    This is out of a horror movie. 

    With their huge budget and full support of fascist govt they'll be everywhere.... sporting events, concerts, shopping, amusement parks. No one will leave their homes but obviously by video they march through neighborhoods too.
