    Smith, a prosecutor, gathers evidence and brings that to a grand jury, which is filled with common folks, perhaps like yourself. The GRAND JURY decides whether charges get filed, not the prosecutor. Special Prosecutors do not get confirmed. Regarding the ruling that his appointment was constitutional , most legal experts considered that to be a partisan sham ruling.
