    Instead, he struck Arlene Alvarez, a 9-year-old girl seated in a passing pickup, killing her.

    “Is Mr. Earls licensed to carry?” a reporter asked during the February news conference, in which his lawyer spoke for him.

    He didn’t need one, the lawyer replied. “Everything about that situation, we believe and contend, was justified under Texas law.” A grand jury later agreed, declining to indict Mr. Earls for any crime.

    The shooting was part of what many sheriffs, police leaders and district attorneys in urban areas of Texas say has been an increase in people carrying weapons and in spur-of-the-moment gunfire in the year since the state began allowing most adults 21 or over to carry a handgun without a license.

    A North Carolina toddler found a gun in his dad's truck and shot himself, and now the father faces criminal charges.

    Investigators say they arrived at the scene in rural Johnston County to find the boy with a gunshot wound. Warren Bennett Oser, 2, was rushed to a nearby hospital, where he was later pronounced dead.

    Detectives believe the 2-year-old climbed into his dad's pickup truck through an open door and found a loaded handgun in the cab. He began to play with the gun and accidentally shot himself, authorities say.

    According to ABC 11, the boy's father, Warren Tyler Oser, is charged with failure to properly and safely store his firearms to protect minors.

    The Johnston County Sheriff's Office tells the station that the boy's death was considered an "unfortunate accident."

    The boy's sudden death has left his family in shock.

    We're having to raise money for a funeral we never expected, for a 2-year-old," a family member told WRAL News. Community members have raised more than $20,000 on a GoFundMe page to cover the boy's funeral expenses.

    In an online obituary, family members remembered the sunny toddler.

    "Bennett was a free spirit with a wild soul who always kept us on our toes," his parents wrote. "He loved to run naked, play with dinosaurs, work with Daddy, snuggle with Mama and play outside.

    "Bennett was a happy child who loved everyone in his life deeply," the obituary continued. "Every single day, he would go down his list of favorite people to try and visit. Though his life was brief, his spirit and memory lives on in his family and friends. We are grateful and blessed that God chose us to be his parents and let us watch over him for even the short amount of time that he had on earth."

    Liability for Unsafely Stored Firearms

    Pursuant to state law, any person who resides with a minor and owns or possesses a firearm stored or left: 1) in a condition in which it can be discharged; and 2) in a manner that the person knew or should have known that an unsupervised minor would be able to gain access to the firearm, is criminally liable for a misdemeanor if the minor gains access to the firearm and:

    • Possesses the firearm on educational property;
    • Exhibits the firearm in a public place in a careless, angry or threatening manner;
    • Causes personal injury or death with the firearm, except in self-defense; or
    • Uses the firearm in the commission of a crime.3

    Under state law, a retail seller or transferor must deliver a written copy of state law relating to storage of firearms to protect minors to the purchaser or transferee with every firearm transfer.4 A retail or wholesale store or outlet that sells firearms must conspicuously post at each purchase counter the following warning:

    ”It is unlawful to store or leave a firearm that can be discharged in a manner that a reasonable person should know is accessible to a minor.”5

    Man who fired AK-47 at couple walking their dog and killed woman, 21, jailed for life


    A man who fired an AK-47 at a couple walking their dog when they encouraged it to "go potty" and killed a woman in the process has been jailed for life.

    Isabella Thallas and Darian Simon had been walking their pet near their home when the tragedy happened.

    Prosecutors said Michael Close got into a “verbal exchange” with the pair as they encouraged their dog to relieve itself.

    Denver District Court heard Close yelled at the pair from inside his home before reaching for the weapon and firing 24 bullets.

    He is said to have shouted: “Are you going to train that f****** dog or just yell at it?”

    Simon responded: “Mind your own business; Rocko is a good dog.”

    Seconds later Close fired the weapon at the pair, killing 21-year-old Isabella who was shot in the back and died instantly in the exchange and wounding her partner in his legs.

    Close fled the scene but was arrested by the Park County Sheriff’s Office hours later.

    Deputies found a gun belt and the rifle. inside his car.

    Close had pleaded not guilty by reason of insanity while his public defender claimed he had a mental break, an abusive childhood, a break-up and a number of lost jobs.

    But jurors convicted him in September of first-degree murder, attempted first-degree murder and two counts of first-degree assault.

    During Friday’s proceedings Judge Lisa C. Arnolds sentenced Michael Close to life in prison without the possibility of parole for the murder of Isabella Thallas.

    He also received 48 years for the attempted murder of Darian Simon which will run consecutively.

    Close was also ordered to pay $37,000 in restitution.

    Judge Arnolds said, “Mr. Close will pay for what he’s done by spending his life in prison.”

    Joshua Thallas, Isabella’s father, told KUSA: “There’s no winners in this.

    “We go home after this, my family broke, still without my daughter.

    “(Close’s) family is broke, believe or or not. He’ll go to jail, they’re without a son, a brother, so there’s no winners in this.”

    Multiple gunmen sought in shooting that injured 9 outside Philadelphia bar

    Nine people were wounded, two critically, when multiple gunmen fired a barrage of at least 40 shots at a crowd gathered on a sidewalk outside a Philadelphia bar Saturday night, authorities said.

    The assailants fled the chaotic scene in the Kensington section of the city in a vehicle and remained at large Sunday morning.

    Asked at a news conference whether the gunmen posed a threat to the community, Deputy Commissioner John Stanford noted the number injured and shell casings littering the street outside Jack's Famous Bar and said, "I think that's a public safety threat."

    The shooting unfolded around 10:45 p.m. as the neighborhood was bustling with more people than usual out enjoying an unseasonably warm November night, Stanford said.

    He said a group was mingling on the sidewalk outside the bar when multiple gunmen exited a black vehicle sitting in the middle of East Allegheny Avenue, near Kensington Avenue, and opened fire on the crowd without warning.

    "At this point in time, it just looks like these individuals may have spotted someone they wanted to shoot at, exited the vehicle and just began firing," Stanford said, adding investigators don't yet know who was targeted or a motive for the attack.

    Stanford said the shooting occurred despite a heavy police presence already in the area. He said officers walking a beat heard the gunfire and rushed to help the men and women injured as the shooters ran back to the dark vehicle and fled. He also noted that a narcotics task force was conducting an investigation a half-block from where the shooting occurred.

    "We have some brazen individuals in this city that don't care. They don't care how many police officers are out here and some don't care in terms of how many people are out here," Stanford said.

    He said investigators recovered at least 40 pieces of ballistic evidence from the scene and plan to comb through surveillance video from businesses in the area in hopes of identifying the assailants.

    He said seven of the victims were in stable condition and two were critical.

    The shooting came amid 5% drops in both homicides and aggravated gun assaults in Philadelphia in the first 10 months of this year, compared to the same time period in 2021, according to the lasted police department crime statistics. Philadelphia surpassed its annual homicide record in 2021, recording of 562 slayings.

    A man who fired an AK-47 at a couple walking their dog when they encouraged it to "go potty" and killed a woman in the process has been jailed for life.

    Isabella Thallas and Darian Simon had been walking their pet near their home when the tragedy happened.

    Prosecutors said Michael Close got into a “verbal exchange” with the pair as they encouraged their dog to relieve itself.

    Denver District Court heard Close yelled at the pair from inside his home before reaching for the weapon and firing 24 bullets.

    He is said to have shouted: “Are you going to train that f****** dog or just yell at it?”

    Simon responded: “Mind your own business; Rocko is a good dog.”

    Seconds later Close fired the weapon at the pair, killing 21-year-old Isabella who was shot in the back and died instantly in the exchange and wounding her partner in his legs.

    Close fled the scene but was arrested by the Park County Sheriff’s Office hours later.

    Deputies found a gun belt and the rifle. inside his car.

    Close had pleaded not guilty by reason of insanity while his public defender claimed he had a mental break, an abusive childhood, a break-up and a number of lost jobs.

    But jurors convicted him in September of first-degree murder, attempted first-degree murder and two counts of first-degree assault.

    During Friday’s proceedings Judge Lisa C. Arnolds sentenced Michael Close to life in prison without the possibility of parole for the murder of Isabella Thallas.

    He also received 48 years for the attempted murder of Darian Simon which will run consecutively.

    Close was also ordered to pay $37,000 in restitution.

    Judge Arnolds said, “Mr. Close will pay for what he’s done by spending his life in prison.”

    Joshua Thallas, Isabella’s father, told KUSA: “There’s no winners in this.

    “We go home after this, my family broke, still without my daughter.

    “(Close’s) family is broke, believe or or not. He’ll go to jail, they’re without a son, a brother, so there’s no winners in this.”
