    I agree. Without knowing the details of the case I would also say it doesn’t matter who fired the fatal shot. If they were both involved of illegal and careless discharging of a firearm, they are both guilty.
    Maybe the details of the case would explain why they needed to know which one, maybe not. I don’t know.

    Because no prosecutor would try a case that they know from the start they can't win.

    No proof, no chance of winning......no case.

    It really sucks but that's the way it works in our legal system. 

    It's not like they set out to murder someone, it happened accidentally. Hence the above comment.

    I thought part of being a “responsible” gun owner was knowing what is down range? Negligent homicide? Two guys rob a store, not setting out to murder anyone. Gun accidentally discharges, killing someone, maybe one of the robbers. The survivor or both robbers get charged, tried, convicted, do time. In the example I cited, neither were charged. Innocent dead guy, two “responsible” gun owners walk free. Flo Rida.

I posted it to counter the narrative, posited by some, that the black community needs to get their house in order to solve gun violence in their communities.     Who is speaking of murder? There is a large range of other charges that can be laid when an individual causes the death of another person short of murder. Careless discharge of a firearm is just one example.

    And this would be an extremely winnable case in many, many jurisdictions, including many states.

    "Setting out to rob a store" is a crime and someone getting killed as a result lies on the shoulders of the criminal. I don't have a problem with that. 

    Stray bullet from range outing? Different circumstances altogether. 

    I'm not saying that it's right, but it's not as simple as locking up everyone who was there.

    OK. There are charges that could have been filed. The chances of a conviction without a known defendant?....not likely.

    And in other news: Tens of millions of gun owners didn't shoot anyone or negligently allow others access to their firearms. 

    If only that were the case for all of them. Unfortunately, it's not.
