New Evidence in the West Memphis Three...

I know this subject was a decent sized discussion on here when Eddie participated in the benefit concert for the West Memphis Three....I took notice of the case years before, being that I'm a law junkie...and I've kept up with it since the Arkansas Supreme Court granted the chance at a new trial back in, I think December...

On July 27th news broke that DNA proves that NONE of the three guys currently in prison were at the murder scene..The link below will take you to the article.....Highlights below...

"Newly tested DNA evidence in the 1993 killings of three 8-year-old Cub Scouts in Arkansas has failed to link the crimes to the men convicted in the murders, including one on Death Row, advocates for the men said on Wednesday.

The DNA, including materials from the crime scene, instead matched three unidentified people, furthering supporters' claims that the so-called West Memphis Three are innocent, the advocates told Reuters.

There were no DNA matches for Damien Echols, Jason Baldwin and Jessie Misskelley Jr, who were convicted of the crime, said Capi Peck, a co-founder of Arkansas Take Action, a civic group working to free the trio.

"This newly discovered DNA evidence that excludes Damien, Jason and Jessie, combined with all other evidence of their innocence, will hopefully lead to a new trial," she said.

A status report on the DNA was filed on Monday in Craighead County Circuit Court in Jonesboro, Arkansas.

The Arkansas Attorney General's office declined to comment, citing a gag order."

    lol...OK technically it showed that DNA taken from the murder scene does not match the DNA from any of the 3 men in jail.

    It doesn't PROVE that they werent there, but the fact that they have NO DNA evidence from the 3 men in jail but do have DNA evidence of three unknown men....does a lot to prove they weren't there in my mind.

    The secondary issue beyond freeing the WM3 is how three people can be convicted without evidence. Hopefully, their new trial will end the madness. Of course, this means the real killers got off and likely are still around. Double injustice!

    Precisely - however it sounds like this will likely be retried.

    I have no stance on this case since I don't know enough about it to have an opinion, but given that Casey Anthony was recently acquitted and there was lots pointing at her (let alone being convicted for obstructing the police investigation), I think when this goes to trial they'll be set free soon thereafter.

    To learn more, visit www.wm3.org or watch Paradise Lost 1, 2, and the new 3. The movies were made by HBO and interestingly capture most of the insanity during the initial trial. Crazy to have a trial so well documented. There is ample reason this case has many up in arms.

    I wonder why the documentary never discussed Damien Echols mental illness and his behavior, that landed him in a mental hospital. I wonder why they never discussed Damien Echols threatening to kill his parents, and threatening to kill police officers. I wonder why that documentary never discussed how Damien Echols was on permanent disabilty due to his mental illness. I wonder why that documentary never discussed Damien Echols medical records. I wonder why they never discussed Damien Echols arrest record.

    I guess it wasnt relevant...

  • Hell of a guy Damien Echols.....

    Paradise Lost, Devil’s Knot and legions of WM3 supporters depict Damien Echols as an eccentric but harmless teenager. He was alienated, misunderstood, a goth surrounded by rednecks. He suffered from mild depression and run-of-the-mill teenage angst. Maybe he was a little weird, but that doesn’t mean he killed anyone.

    Don’t believe it. Damien Echols in 1992-93 was extremely disturbed and violent. He was institutionalized three times in the year before the murders. He made a suicide pact with his girlfriend. He threatened to kill the girlfriend’s father. He threatened his father with a knife. He threatened to kill his mother by slicing her throat. He threatened to eat his father. He threatened suicide regularly, by hanging himself or drinking bleach. He tried to gouge his ex-girlfriend’s new boyfriend’s eyes out with fingernails he kept sharpened to talons. He set fires at school and burned himself. He cut himself with knives. He tortured and killed cats and dogs. He drank other people’s blood and told a psychiatrist that drinking blood gave him power, made him “feel like a god”. He talked about getting his girlfriend pregnant, then using the baby as a human sacrifice. He claimed to be possessed by a spirit and to converse with demons.

    That’s not ordinary teenage angst. Damien Echols was a dangerous psychotic at serious risk of harming himself or someone else, and everyone around him knew it.

    How do we know so much about Damien Echols’ psychological history? Because Echols’ own defense team released his medical records as Exhibit 500 during the sentencing phase of his trial. His lawyers hoped that the overwhelming evidence of Echols’ mental illness would elicit sympathy and convince the jury to spare him the death penalty.

  • Did Vedder say on Larry King he hired some people to do research and met with D.E himself before he actually got behind the WM3 case? I thought on one of the videos I saw Ed say that. Other than some articles and the documentary's haven't really followed it much. Speedy Mac, your not buying it? You think WM3 are guilty? Thanks for your info, I have not seen the other side of the story, but yours was interesting, I had not known any of the info you provided about D.E. Is there some read I can check out as well with objective sides to both?

  • def. not, in the documentary I saw they keep saying Misskelly gave that statement after hours of being questioned without lawyer present and they spin it like he was forced because of his iq he didn't understand anything.....can you tell me where you get your info from, I really do want to see both sides of this case. I have just seen the pro WM3 side and would like to read into it more.

    Just google "West Memphis 3 GUILTY"...

    You will find lots and lots of various websites that have all of the FACTS of the trial, medical history, and background of the 3 convicted child murderers.

    For years and years I have been here discussing Mr. Echols..
    One thing I know for sure...

    Based on his medical history and his behavior prior to being convicted of murder.
    Damien Elchols has always come across to me as A PIECE OF GARBAGE!!!!

    Why should I want this guy walking the streets??
    Why should I send money to free this guy??
    Because Eddie Vedder says so???

    Would Eddie Vedder let this guy babysit his children?
    Would Eddie Vedder invite this guy over for Christmas dinner?

    You obviously have your beliefs and are righty entitled to them. I do not condone any of the acts you mention. I also feel strongly that there is no evidence to support this murder conviction by the WM3. The Misskelly "confession" holds no credibility with me as a minor was questioned in the middle of the night for hours on end, without his parents or lawyer present. Couple that with the preponderance of inaccuracies of his "confession" and you get what I think amounts to a kid scared out of his wits trying to tell the police whatever they wanted to be let go. Further supports this theory is that he is mentally challenged. Oh and by the way, he recanted his "confession" and refused to testify during the others' trial as he knew what he said wasn't true. Only by jury misconduct did this become an issue since the foreman knew of this "evidence" even though it wasn't presented at the trial. Justice for all or justice for none. There is also good reason the WM3 are getting a new trial. Let us not forget the 3 boys who died also have not got their due justice.

  • On 5/9, Damien, Jason and Domini told police officers that all three had gone to Jason’s uncle’s house that day, where Jason mowed the lawn. Damien called his father for a ride. Damien’s father picked up Damien, Jason and Domini around 6:00 PM at a nearby laundromat. They drove Jason and Domini home, then Damien went home with his father.

    On 5/10 (report 1, report 2), Damien told police a different story. He had been with Jason and Domini at Jason’s uncle’s house earlier in the day. He called his mother for a ride. Damien’s mother picked up Damien and Domini (but not Jason) at the laundromat and drove Domini home. Then Damien, his mother, his father and his sister all visited the home of Randy and Susan Sanders, where they stayed from 3:00 to 5:00 PM. (This would mean that Damien and Domini were picked up at the laundromat around 2:00 or 2:30 PM, not 6:00 PM as they stated the day before.) When he got home, Damien talked on the phone with a girl named Holly George until 11:00 or 11:30 PM.

    On 5/10, Domini Teer also talked to police. She said that she, Damien, Jason and Ken Walker were at Jason’s uncle’s house when Jason mowed the lawn. Damien’s mother picked up Damien and Domini from the laundromat, “the time was about dark or just before it got dark” (sunset was 7:48 PM). Domini says she called Damien from her home, and “that he told her he was tired and was going to sleep”. The police report adds, “Domini’s mother stated that Domini came in when Time Trax was on TV on Wednesday evening” (Time Trax started at 7:00 PM).

    On 5/12, Damien’s mother, Pamela Hutchison, told police that Damien called for a ride from the laundromat at 3:45 PM. She picked up Damien and Domini, drove Domini home, then arrived home with Damien at 4:00 or 4:10 PM. The whole family went to the Sanders home around 6:00 or 6:30 PM, came home an hour later, Damien stayed home the whole night. Pam Hutchison said she dropped off Damien’s prescription at 12:30 PM Wednesday and picked up the filled prescription Thursday morning.

  • On 5/17, Susan Sanders confirmed Pamela Hutchison’s account. “Susan Sanders stated that on 5-5-93 between 6:30 and 7:00PM she left her residence and went to the Splash Casino in [Mississippi]. Her daughter Stacy Sanders told her that somewhere between 7:00PM and 7:15PM Damien and his mother showed up at her residence they stayed about 15 minutes and left. 2 days later Damien’s mother told her (Susan Sanders) that the police would come by her house and ask her questions and told her to remember that her and Damien came to visit her on 5-5-93 that evening. Also told her that Damien didn’t kill those boys he was with her all night.”

    Neither Jason Baldwin nor Damien Echols talked to law enforcement after their arrests, but their families and lawyers tried to establish alibis for them. By this point, Baldwin’s and Echols’ alibis contradicted each other

    This doesn't prove murder! Again supports the idea of scared kids saying anything to get out of trouble. Damien would be the first to tell you that he would approach this differently if he could do this all trial part over. Proving a negative is very challenging especially when the cards are stacked against you with jury misconduct.

    Because many people, myself included, feel 3 innocent people are locked away! While tragic to allow a guilty person to go free, it is far worse to lock up the innocent.

    We likely wouldn't have anything in common. If the shoe were on the other foot, I doubt he would advocate for me. Doesn't change my moral compass that what happened to him is wrong regardless of your listing of his prior wrongs. Violence is wrong and I'm clearly not justifying his other actions/threats. <sorry having trouble editing text on iPad - disregard following text>
