The hearings the other day went well, I think there will be a new trial (or similiar) in the months/years to come and the WM3 will be freed soon thereafter. The supreme court of Arkansas looked as if they were leaning towards a new trial.

It's pretty simple to me. No DNA was found from the WM3 at the crime scene or on the bodies. Hair/DNA was found of Terry Hobbs in one of the boys shoelaces used to tie him up and his buddy he was seen with that day left hair/DNA on a tree stump at the crime scene. So it doesn't take a genius to figure out what really happened to the murdered boys, the problem now is that that this judicial system is so complicated and unclear.

It saddens me with all this new evidence and looking back at the old botched evidence and facts, there are still people trying their hardest to keep the WM3 in jail. Ridiculous.

About the parents of the WM3 mentioned in above post, the WM3 come from fucked up broken homes, and were all extremely poor. What can the parents possibly do that can help their children, that trained and intelligent defense attorneys can't do 1000X better, nothing. They are helpless. Besides all the death threats I am guessing the parents of the WM3 got around that time, there is really nothing they can do.

I didn't know about Terry Hobb's friend's DNA being found at the crime scene too. If that evidence had been available at the original trial I don't think we'd be here discussing this case right now.
  • The Arkansas State Supreme Court usually releases opinions at 9AM on Thursdays. I really thought there might be something on the case today. I guess they could hand down a ruling at any time, but it looks like probably another week before they issue any more opinions.

Why can't they just see that they're innocent and let them go already! C'mon Arkansas--enough is enough.
  • I have no real idea if this plays any part in the decision making process and the timing of a ruling, but I have to think that as with everything, politics has something to do with the timing of the Arkansas Supreme Court and their release of this opinion. Since this high profile case directly involves the Attorney General and his office, the Supreme Court may not have wanted to be seen as influencing the election process in any way. Now that the elections are over, and the Attorney General has been decided, they may feel they can release an opinion without influencing the election. Let's hope we hear something good tomorrow.

The court ruled Thursday in three separate opinions that all three men will get new hearings "to determine whether a new trial is warranted."

Lonnie Soury, a spokesman who has been active in the effort to free Echols, Baldwin and Misskelley, said the new hearing for Echols was the best development in the case short of an overturned conviction.

"This is essentially the first good news Damien Echols has had in the 17 years he has been on death row," Soury said, adding Echols likely learned of the hearing Thursday morning by phone

Hopefully the state will just let it go to retrial. If I was an Arkansan, I would be pissed that the state wants to continue wasting tax dollars prosecuting three innocent people.

You make a good point. I guess I get tired of the general over-sensationalism which the media tends to delight in.

Cases like this deserve a certain sensitivity and respect.

We decline the invitation to interpret the statutes in this way because it would render them meaningless. ... This court will not interpret a statute to yield an absurd result.

Was interesting, that part about whether the DNA evidence could ever yield a positive proof of innocence. Not sure I understood it completely, but were they broadly pointing out that the WM3 are in a kind of 'catch 22' if they have to 'prove their innocence' using DNA evidence? Sounds pretty critical for the terms of the hearing.... wish I understood it better!
