as a prospective juror, how would a criminal defendant refusing to testify make you feel? what would be your reaction? i'm supposed to be researching this for a case and i'm coming up blank.
    and like that... he's gone.
  • Why would you think you're the only person who actually LIKES jury duty? I do, in fact I LOVE it. I was bummed out last time I was called, because I was unable to serve.

    LOL....mabe a little.

I was the presiding juror last time, and I got to say that I preferred that seat to the alternative juror who didn't get to deliberate at all.

it would make me look at the prosecution's evidence more closely....

Huh, good question. How would that make me feel....

I guess it would be irrellibant because as a juror all I can go off of is what is presented to me in court. If no testimony, then nothing to go off of.

that's the way it's supposed to be. no one can comment on the fact that a defendant does or doesn't testify. it's their fifth amendment right. but obviously any jury wants to hear what the defendant has to say for himself, wants to hear him deny it and so forth... at least on a subconscious level. i'm supposed to see if there is any research on how much of a role that can play. we need to figure out if we're going to put our client on the stand or not.

While I've been summoned a few times I've never served, so I can't say if I'd like it or not. It's always been a bad time for me, so I've been glad that I wasn't called. I'd have to say that it's about 50/50 for the people I know though. I'm glad you like it as it is an important job. Hope you get on an interesting one. :)

    it's fascinating!!!!
"I'm not present, I'm a drug that makes you dream"
  • i will never serve. ever. period.

I was called up last year and was going to refuse but luckily they dismissed me and a bunch of other people, just as we sat and waited to talk to whoever interviews the jurors.

As far as I am concerned, as someone who has contributed money and has merch from Mumia, the Wm3 and Peltier, and who thinks the justice system is irreversibly currupt and full of lies, I dont see why they would even want me on a jury.

I think its all a load of pretense. I have no faith in the justice system. Who the hell would? I mean the Wm3 were just denied a new trial despite overwhelming evidence that they are completely innocent and that Terry Hobbs murdered those three kids. Why would I want to participate in that charade?

One has to only look at american history to realize its all a sham. American justice at its bedrock is this: 401 treaties promised to the Native Americans. Not a single one was honored. Thats your justice system people. Not to mention the overtly racist aspect of it.

I proudly stand here and say if called up, I would show up, but would tell them at the interview all that I just typed above and mention of course "as george carlin said, 'I can tell they are guilty just by looking at them'. I would refuse to even deliberate.

How can a justice system so horribly wrong be praised by anyone here? In response to Hunter S Thompson's assertion that Bush was worse than Nixon and the question of what to do about it, Dylan once said "we dont have to be like them". I agree. I refuse to participate and be made a fool, all the while innocent folks like Mumia, Peltier or the Wm3 languish in a jail cell

What could you possibly learn? If you are reasonably socially and politically aware, you know everything you need to know about the 'justice' system. Those quotes around that term are intentional.

Remember: Innocent till proven guilty. If the evidence is not overwhelmingly clear that the defendant is guilty, then you can't vote him guilty.

    i HATE jury duty.
scratch that, i HATE waiting in lobbies for eight hours a day.
it's like the eternal doctor's office.
although i heard they have wifi now...that would make the wait 1% more tolerable.

    i don't get summoned anymore.
    the key: i stopped voting.
all you jury duty haters should try it. :)

I knew a guy who said he hated everybody to get off jury duty.

Personally, I'd love to get on a big federal case, maybe there'd be a book deal out of it..

I just got off of my 3rd term in 5 years. I think it's interesting, but the part I don't like is seeing government bureaucracy at work (going down to the courthouse, etc.)

  • I just did a while ago and chose to postpone.....turns out I picked the week my wife is due to have our child....I wonder if you can postone again?

Last time I went in New Britain, we watched movies all day, I told them how much I despise frivolous lawsuits and I was out.

I think I'd refuse to sit. I wouldn't feel comfortable having that kind of power without any kind of expertise. Who the hell am I to decide that a person is guilty or innocent based on the SKILL of a lawyer and how they presented the case to me? That's not proof of anything.

A jury might be the only "fair" way but it's not something I'd be comfortable with at all.

An 18 year old boy killed two people here. The lawsuit was on the news for weeks. Two experts gave their opinion about the boy's mental condition. They had different opinions, of course. The jury had to decide which one was right. What the hell?

I hear you. Except I'd probably be thinking, "Shit, if they want this guy locked up, they'd want me executed."

Yeah, the judge bought us lunch on our last day too during deliberations. I think that was mainly so we would continue to deliberate white we ate.

If nothing else, I hope to get some good reading time in.
