I think they should take all the publicity they can get. Has anyone even paid attention to Heart since 1980?
I have. I've seen them a bunch of times, and see them every time they play Seattle. Mike Inez from Alice in Chains spent years as their bass player. They are part of the Seattle scene. PJ brought them out for RITFW in Vegas in 2003 when I was down there. McCready took the stage with them at the EMP a few years ago. So yeah, people who matter still pay attention to them.

This is what I don't get, you hear this thing happening so frequently during elections. You would think with all the money these parties are spending, and all the lawyers on staff, there is no one there who might mention to the candidate that doing that sort of thing is a copyright infringement.
I guess you all missed this part of the article from the first post:
"Copyright law may not be on the Wilsons' side as the song is licensed for public performance under a blanket fee paid by the venue to ASCAP, the firm that collects royalties on behalf of composers and copyright owners."
My cousin works for ASCAP and he told me that since they were in a venue that had paid the afformentioned blanket fee, they are free to use any song that ASCAP licenses without committing any kind of copyright infringements. This is the same agreement that lets sports venues use songs like "We Will Rock You" and "Rock & Roll Part II" as often as they want without having to pay the artist each time it's played. So Van Halen, Heart and Jackson Browne can sue all they want... they won't be able to do anything unless the McCain campaign uses these songs in a venue or establishment that hasn't paid the ASCAP blanket fee.

Yes I saw it but the bands can be pissed about it if they chose to right.

Of course they can, and if they are not McCain supporters, then they should be pissed. But I was just pointing out that there was nothing illegal about what they were doing as some people thought.

Because who knew Jackson Browne and Heart would be such hateful bitches? Especially when they are D list musicians.
You've just never been to a Heart concert, then judge if they're a D list musicians.

well thank goodness they lashed out. for a second, I thought the Wilson sisters endorsed Palin! I mean, could you imagine if word got out that a musician would support anything Republican? Wow, I mean what a career killer!
hey man, it's the republicans' own fault. i remember during the mccain flap some republican was whining about how it's tough to find good songs with wide appeal for their candidates because the only republican artists are country singers. there's a reason that every single person capable of producing great art that embraces empathy, an understanding of the human condition, and a message that resonates with the public is produced by liberal
glad these chicks did this ........f those fn republicans and any fans from here who think that the reps are correct in doing this,i'm no fn republican ..did i put enough f's in this post ?? ..

Why are liberals so weak? Every little thing they bitch and moan. It is tiring. Oh no, the republicans played a Heart song. Is this a big deal? Or does it show the mean, angry, spitefullness, pettiness of the Democratic party? Palin had a nickname Barracuda, so they played that song. It is sad and embarrassing what Heart and Jackson Browne are doing.
I'm sorry you are all so hatefull and raging right now that you can't enjoy your own existense.
does the GOP vet anything??? stick to country songs kids....unless you play some nugent whatever song you choose you're gonna get shit for
You'd think that they would select music from performers that support the Republican Party instead of drawing the negative publicity. Oh, wait. Sorry, we're talking about the REP Party. They don't think about the consequence of their actions. Oh, wait. Sorry. They don't think.

The sad thing is the Democratic policies are so brutal that the Republicans continually beat them. Hell, even now the election is close.
True... But at least we don't have 4 more years of King George. That's the only positive thing I can see out of another republican in office.
Agreed. But does anyone agree with me that Jackson Brown and Heart are being extremely petty? Do you think U2 would have an issue with McCain using their song like Barack does? I doubt it. Because they aren't partisan hacks.

Petty? Yes. Legal standing? Probably not. D-Listers? NO. Still relevant in the industry? Absolutely.
The republicans brought it on themselves. Even if they are allowed to use it thru ASCAP, they really should anticipate this sort of thing and bring it up with the artist first, just to avoid the PR blunder.

what is sad and embarrassing is that the only artists that republicans can get to swallow their bullshit are redneck country motherfuckers.
whine a little more about how unfair we're being to palin. the hypocrisy is amusing.

i think they would ask him to start. this isn't just jackson browne or heart. artists have done this for decades. bruce springsteen. tom petty. bryan adams. john mellencamp. they've all asked republicans to stop using their music to sell ideas they find unconscionable. how is this any different from a band now wanting their music used in a commercial? if it's ok for them to control what their music sells, why does it stop at politics?

the right has no soul.
of course it is the republicans fault. I, like some find the whole thing to be a touch petty. I mean why 'lash' out? I mean the song kicks ass and it fits. Nobody is out there (I would hope not) saying "Wow, I can't believe the Heart sisters are endorsing Palin". If I were the Wilson sisters, I would be honored that one would choose such a kick ass song but at the same time, tell them they never got permission to use it. Respectfully tell them to stop.
I also doubt that Heart are all pissed about the copyright part. Probably 10,000 people illegally downloaded that song after hearing it the other night. I wonder if they have a big problem with that?
that being said, I fucking love Heart and it made me go back to the first cassette I ever purchased in my life. Magazine.

No soul...love that one.
Isn't that pretty much all they did? The headline was that they lashed out... the story was that they sent a cease and desist letter, and didn't make a very big deal about it at all.
Smokey Robinson constantly looks like he's trying to act natural after being accused of farting.
Jackson Browne was one of the musicians on the Vote for Change tour. I think he, the Wilson girls and anyone else who does not share the same "values" as a republican would not want their name or music associated with that party. I think this is what it all boils down to. I don't think it's about the royalties.

how do you expect pearl jam would respond if dubya had tried to use... say... glorified g in a campaign song? (reagan did this with born in the usa). the point is, these artists are NOT honored. they are upset that their music is being associated with and used to sell a message which goes directly against everything they stand for. heart asked them to stop. as have a dozen artists before heart. this is nothing new, and i see nothing wrong with it. this isn't about album sales or copyright issues. this is about ideology and personal politics. pearl jam took on ticketmaster over less.

differently than if say Obama tried to use a PJ song without permission. that is my point. I fully understand why, just be respectful about it. Take the road the 3rd person that co-wrote that song did. That is all.
If I wrote a song that Obama loved and used, I would be honored that someone enjoyed my song enough to use it. I would then tell him to stop.
Agreed. But does anyone agree with me that Jackson Brown and Heart are being extremely petty? quote]
i disagree. i don't think its petty at all. Imagine someone you did not support or agree with at all pushing ideas and agendas you were vehemently opposed to began waltzing around waving with shit eating grins on their faces with YOUR work blaring in the backgound. You wouldn't have a problem with that? Personally, and its a pure hypothetical of course, if McCain and Palin were smiling at folks and doing their little pageant wave to the rhythm of music I composed and words that I wrote, i'd emphatically and publicaly demand they knock it off imediately. Its not about money or royalties. Its all about principle and integrity. i'm sure Toby Keith has a large enough catalog that they can find something to pull fom.
"When all your friends and sedatives mean well but make it worse... better find yourself a place to level out."
What made them think they could use a song without asking the artist first?
Do the publicans do ANYTHING taking in consideration by asking anyone first????? Hell NO! The world is their oyster and they dont have to ask for shit they just take...
Comments
I think that by pulling the song they get their publicity.
