    Analysis: Under oath, Trump is confronted with his ‘hoax’ hyperbole 

    In the abstract, former president Donald Trump’s general lack of credibility on what may or may not be a hoax is not terribly important. But in the context of a lawsuit centered on allegations that he sexually assaulted author E. Jean Carroll several decades ago, Carroll’s attorneys found it useful to point out that Trump simply says everything is a hoax, even when he obviously doesn’t think it is.

    As when he said that about Carroll’s accusations.

    As Philip Bump writes, a portion of Trump’s sworn deposition was published Wednesday, offering insight into the questions being presented to the former president as he seeks to defend himself against the charge that he defamed Carroll in denying her assault allegations.

    Per Phil:

    The transcript also depicts an obviously angry and frustrated Trump lashing out at the questioners and disparaging various other perceived enemies, like New York Attorney General Letitia James (D).
    At one point, Trump was presented with a social-media post he published about the situation in which he declared that “it is a hoax and a lie just like all of the other hoaxes that have been played on me for the past seven years.”
    “I take it what you’re saying there is Ms. Carroll fabricated her claim that you sexually assaulted her; correct?” a lawyer for Carroll asked.
    “Yes. Totally,” Trump replied. “100 percent.”
    “Fair to say — you’d agree with me, would you not, that you use the term ‘hoax’ quite a lot?” the lawyer continued.
    “Yes, I do,” Trump replied, later adding that “I’ve had a lot of hoaxes played on me. This is one of them.”
    “How would you define the word ‘hoax’?” the lawyer asked.
    “A fake story,” Trump replied — “a false story, a made-up story.”
    This is fairly accurate, really. Trump obviously uses “hoax” not in the sense that most people do but, instead, to describe something that he would like to argue is overstated or inaccurate. That those things are generally not inaccurate or overstated but often at most included contested elements has certainly never prompted Trump to moderate his disparagement.
    For Carroll’s lawyers, though, this is useful. Trump calls Carroll’s claim “a hoax” — just as he did other things that are obviously not hoaxes. Things that he was simply trying to dismiss or disparage because they were correct or accurate...
    But Carroll’s lawyers wanted something more concrete to demonstrate his flippancy on such allegations. So they walked him through some.
    “Isn’t it true,” an attorney asked, “that you also referred to the use of mail-in ballots as a hoax?”
    “Yeah, I do. Sure,” Trump replied. “I think they’re very dishonest. Mail-in ballots, very dishonest.”
    Then the lawyer struck: “Isn’t it true that you yourself have voted by mail?”
    “I do. I do,” Trump admitted. Then, a bit of moderation: “Sometimes I do. But I don’t know what happens to it once you give it. I have no idea.”

    You get the point.

    Trump says he will give ‘big political speech’ Thursday, promises ‘many giant rallies’


    Former President Trump teased a “big political speech” he planned to deliver on Thursday, promising rallies and “wild and exciting” events for supporters as he rolls out his 2024 presidential campaign.

    “Making a big political speech today at TRUMP DORAL, in Miami,” Trump said in a post on his social media platform Truth Social on Thursday morning while claiming the media has accused him of “not campaigning very hard.”

    Trump maintained the election is “still a long time away,” adding, “But do not fear, MANY GIANT RALLIES and other events coming up soon. It will all be wild and exciting.”

    The conservative government watchdog group Judicial Watch announced on Thursday that Trump was slated to be the keynote speaker at the organization’s annual roundtable, a private event, Thursday evening.

    “President Trump engaged in a historic battle against government corruption and abuse, a battle which continues to this day,” said Tom Fitton, the organization’s president, in a statement. “We are honored he will address and educate Judicial Watch’s supporters about the ongoing rule of law crisis that so threatens our Republic.”

    The former president did not specify when he would deliver the speech from his Miami resort or what it would be about, but the announcement comes as some GOP strategists have started to criticize his 2024 campaign rollout as anemic.

    The run-up to Trump’s 2024 announcement was rocky, with many in the party pointing the finger at him for some of the less-than-stellar results for the GOP in the November midterms, particularly the performance of some Trump-backed Senate candidates.

    Trump also faces a potential collision course with Florida Gov. Ron DeSantis (R), who is seen as a rising star in the party and could be one of Trump’s main rivals in the 2024 GOP presidential primary.

    But Trump has touted what he sees as his strength over DeSantis. This week, a Morning Consult poll found Trump with a 17-point lead over DeSantis in a hypothetical match-up.

    Trump and lawyer ordered to pay $1m for bringing ‘frivolous’ lawsuit against Hillary Clinton

    Afederal judge has ordered Donald Trump and one of his attorneys to jointly pay nearly $1m in penalties for pursuing a frivolous lawsuit that accused Hillary Clinton, the Democratic National Committee and other perceived enemies of the former president of engaging in racketeering and concocting a vast conspiracy against him.

    The suit was dismissed in September and Trump was ordered to pay tens of thousands in November after one defendant sought sanctions. The latest order came after a group of the remaining defendants, including Clinton, filed a separate request for sanctions.

    The end of the lawsuit marks the latest legal setback for Trump as he grapples with an array of civil and criminal investigations, including the probe into his retention of sensitive documents, while some of his lawyers are under scrutiny themselves for conduct in those cases.

    In a scathing ruling, US district court judge Donald Middlebrooks castigated Trump and his lead attorney, Alina Habba, for abusing the legal system by advancing a lawsuit that furthered his political grievances over the 2017 Russia investigation using arguments replete with misinformation and errors.

    “We are confronted with a lawsuit that should never have been filed, which was completely frivolous, both factually and legally, and which was brought in bad faith for an improper purpose,” Middlebrooks wrote in the 46-page order imposing sanctions of $937,989.39 against Trump and Habba.

    The lawsuit, originally filed by Trump in March 2022, alleged that Clinton and the Democratic National Committee conspired with senior FBI officials and others before the 2016 election to fabricate ties between the Trump campaign and Russia in order to damage him politically.

    But Middlebrooks dismissed the case after he found that Trump engaged in a scattershot pleading that amounted to an obstruction of justice, and which included allegations that were known to be false. His legal arguments, including racketeering and conspiracy, were found to be without foundation.

    The judge noted for instance that Trump’s allegations that former FBI director James Comey conspired with Clinton to prosecute him was wrong – as Trump was never prosecuted – while such a conspiracy was implausible since Comey likely damaged Clinton’s 2016 campaign by reopening the investigation into her emails.

    “I find that the pleadings here were abusive litigation tactics. The complaint and amended complaint were drafted to advance a political narrative; not to address legal harm caused by any defendant,” Middlebrooks wrote of Trump’s lawsuit.

    The judge also found that Trump’s racketeering and conspiracy lawsuit appeared to be part of a pattern by the former president of misusing the courts by filing frivolous lawsuits in order to serve a political purpose.

    “Misuse of the courts by Mr. Trump and his lawyers undermines the rule of law, portrays judges as partisans, and diverts resources from those who have suffered actual legal harm”, he wrote.

    Middlebrooks examined other seemingly politically motivated lawsuits filed by Trump and wrote that they all followed a playbook of including provocative rhetoric, political language carried over from rallies, attacks on political opponents, and ,typically, a lack of legal analysis.

    “Trump is a prolific and sophisticated litigant who is repeatedly using the courts to seek revenge on political adversaries. He is the mastermind of strategic abuse of the judicial process,” the judge wrote. “He knew full well the impact of his actions.”

    The immediate fallout of the sanctions order was not clear. Trump had wanted to drop the lawsuit after the case was assigned to Middlebrooks, an appointee of Bill Clinton, but Habba told Fox News in a segment referenced in the ruling that she had advised him to press ahead.

    Trump and Habba – as well as her law firm Habba, Madaio and Associates – are jointly liable for the $1m penalty, though the former president indicated to associates that he essentially believed it should be paid by his attorney instead of him, according to sources familiar with the matter.

    A spokesperson for Trump could not be reached for comment. A spokesperson for Habba did not provide comment.

    The penalty handed down by the judge, designed to disincentive future frivolous lawsuits, is in addition to a $50,000 fine imposed in November and $16,000 in reimbursement of legal costs for Charles Dolan, a Democratic public relations executive, who filed the first sanctions request.

    The end of the lawsuit marks the latest legal setback for Trump as he grapples with an array of civil and criminal investigations, including the probe into his retention of sensitive documents, while some of his lawyers are under scrutiny themselves for conduct in those cases.

    In a scathing ruling, US district court judge Donald Middlebrooks castigated Trump and his lead attorney, Alina Habba, for abusing the legal system by advancing a lawsuit that furthered his political grievances over the 2017 Russia investigation using arguments replete with misinformation and errors.

    “We are confronted with a lawsuit that should never have been filed, which was completely frivolous, both factually and legally, and which was brought in bad faith for an improper purpose,” Middlebrooks wrote in the 46-page order imposing sanctions of $937,989.39 against Trump and Habba.

    The lawsuit, originally filed by Trump in March 2022, alleged that Clinton and the Democratic National Committee conspired with senior FBI officials and others before the 2016 election to fabricate ties between the Trump campaign and Russia in order to damage him politically.

    But Middlebrooks dismissed the case after he found that Trump engaged in a scattershot pleading that amounted to an obstruction of justice, and which included allegations that were known to be false. His legal arguments, including racketeering and conspiracy, were found to be without foundation.

    The judge noted for instance that Trump’s allegations that former FBI director James Comey conspired with Clinton to prosecute him was wrong – as Trump was never prosecuted – while such a conspiracy was implausible since Comey likely damaged Clinton’s 2016 campaign by reopening the investigation into her emails.

    “I find that the pleadings here were abusive litigation tactics. The complaint and amended complaint were drafted to advance a political narrative; not to address legal harm caused by any defendant,” Middlebrooks wrote of Trump’s lawsuit.

    The judge also found that Trump’s racketeering and conspiracy lawsuit appeared to be part of a pattern by the former president of misusing the courts by filing frivolous lawsuits in order to serve a political purpose.

    “Misuse of the courts by Mr. Trump and his lawyers undermines the rule of law, portrays judges as partisans, and diverts resources from those who have suffered actual legal harm”, he wrote.

    Middlebrooks examined other seemingly politically motivated lawsuits filed by Trump and wrote that they all followed a playbook of including provocative rhetoric, political language carried over from rallies, attacks on political opponents, and ,typically, a lack of legal analysis.

    “Trump is a prolific and sophisticated litigant who is repeatedly using the courts to seek revenge on political adversaries. He is the mastermind of strategic abuse of the judicial process,” the judge wrote. “He knew full well the impact of his actions.”

    The immediate fallout of the sanctions order was not clear. Trump had wanted to drop the lawsuit after the case was assigned to Middlebrooks, an appointee of Bill Clinton, but Habba told Fox News in a segment referenced in the ruling that she had advised him to press ahead.

    Trump and Habba – as well as her law firm Habba, Madaio and Associates – are jointly liable for the $1m penalty, though the former president indicated to associates that he essentially believed it should be paid by his attorney instead of him, according to sources familiar with the matter.

    A spokesperson for Trump could not be reached for comment. A spokesperson for Habba did not provide comment.

    The penalty handed down by the judge, designed to disincentive future frivolous lawsuits, is in addition to a $50,000 fine imposed in November and $16,000 in reimbursement of legal costs for Charles Dolan, a Democratic public relations executive, who filed the first sanctions request.

    I don't think so...the judge must have thought that the attorney should have known better. 

    Honestly the attorney was likely starstruck and thought it would be good for her career. Totally backfired but fuck her.
