    I don't care what the legalese is.

    And that's a perfectly typical response from someone who doesn't know what they are talking about and is being outclassed in an argument.

    And that's a typical response from an arrogant lawyer. I'm sure you'll go far in your profession.

    Apparently the 10c has stated that this was a mistake. Can we let this battle of "intellect" die now?

    And they said in 2003, specific seat assignments and they went blocks. /quote]

    First, I don't recall them using such specific language in 2003. Second, if they did (and please provide the specific languange) and then used the block system, it would be wrong. Even so, the 10C would have argued I'm sure in 2003 that the block system served the intent of the contract because senior members did get the best seats as the policy provides for.

    That is not the case tonight where the most senior members got the worst seats. It's not the same case.

    Attached is the email we all got about the 2003 tour. I highlighted the seniority part.

    Dear ,

    Your member number is: and expires //03.

    US TOUR TICKET INFORMATION

    *Here it is! Pearl Jam is on tour in 2003! The US dates are official and the
    fan club is offering the opportunity to you, as an active 10c member, to
    purchase exclusive tickets before they go on sale to the general public.
    Take note, this time around you may purchase 2 TICKETS TO AS MANY SHOWS ASYOU LIKE! That means, you will be allowed to purchase 2 tickets to each show, but how many shows you decide to attend is up to you ...

    *Please carefully read and follow the specific instructions on how to obtain
    your Pearl Jam tickets. Mistakes are avoidable, so please read and re-read
    the instructions to prevent any complications with your ticket purchase.

    * Ticket prices for the US tour will range from $35 to $38. The unavoidable
    fees for facility maintenance, parking, and services are added on to the
    base ticket price for each show and are reflected in the tickets totals
    listed. PLEASE NOTE, SINGLE TICKETS ARE NOT AN OPTION. Final ticket price isper pair only.

    *Muy Importante! TO ORDER YOUR TICKETS, PLEASE INCLUDE AN INDEX CARD WITH YOUR FULL NAME, MEMBER NUMBER, SHOW DATE AND CITY, FOR EACH SHOW YOU WISH TO ATTEND. ON THIS INDEX CARD, PLEASE INDICATE WHETHER YOU WOULD LIKE YOUR TICKET CONFIRMATION LETTER MAILED TO YOU (INCLUDE MAILING ADDRESS) OR EMAILED TO YOU (INCLUDE EMAIL ADDRESS). If nothing is specified we will email your ticket confirmation.

    *Please send this information, along with your money order payment, to:

    TEN CLUB TICKETS
    (insert show date and city)
    PO BOX 4570
    SEATTLE WA 98104
    USA

    * Muy Importante! YOU MUST SEND AN INDIVIDUAL PAYMENT AND INDEX CARD FOR EACH SHOW. YOU MUST WRITE THE SHOW YOU ARE REQUESTING TICKETS FOR ON THE OUTSIDE OF EACH ENVELOPE. In other words, each ticket payment for every show you will be attending must be in a separate, individual envelope. If multiple payments are grouped together in one envelope, you risk not getting the tickets you requested. However, if you are sending your multiple payments Priority/Overnight, then you may include all individual envelopes with your separate payments, in one Priority/Overnight envelope. (Remember, FedEx doesn't deliver to PO Boxes).

    *Muy Importante! EACH PAYMENT MUST BE MADE AS A U.S. MONEY ORDER ONLY. IF YOU ARE PURCHASING TICKETS FOR MULTIPLE SHOWS, EACH PAYMENT MUST BE MADE WITH A SEPERATE MONEY ORDER. No other form of payment will be accepted. If you send in a check or credit card number, your payment will be returned and you will lose your chance for tickets. Please make the money order payable to "Ten Club" and please include your full name, show date and city on each money order.

    *Since you are allowed to attend as many shows as you like, the ticket holds
    will be on a "first come, first serve" basis. We are allotted a certain
    amount of tickets for fan club members at each venue, so once they are sold
    out, that's it! We can guarantee nothing, but we will accommodate you as
    best we can. Under the circumstances that the show(s) you wish to attend is
    full, we will return your funds.

    *Muy Importante! YOUR PAYMENT MUST BE RECEIVED BY FEBRUARY 11TH 2003. IF YOUR PAYMENT IS RECEIVED AFTER THIS DATE, WE WILL RETURN YOUR PAYMENT AND NO TICKETS WILL BE ISSUED. PLEASE NOTE, PAYMENTS MUST BE IN OUR HANDS BY FEBRUARY 11TH, SO MAKE SURE TO ALLOW FOR DELIVERY TIME.

    *Once your payment is processed, we will mail or email a confirmation number
    to you. Please indicate which method you would like on the index card
    included with your payment. This confirmation letter will be your temporary
    ticket and you will need to present it when you pick up your tickets at the
    box office. So, don't lose it!

    *If you have not received your confirmation number one week before the show date for which you ordered tickets, please contact tickets@tenclub.net. Please write "NO CONFIRMATION" in the subject line so we can identify you properly. Briefly explain your situation in the body of the email and include your full name and a telephone number where you can be reached.

    *Please do not call or email us in an effort to determine whether we have
    received your payment. Due to the volume of mail, it will be impossible to
    locate your payment. Once your payment is processed, you will receive a
    confirmation letter. The fewer questions we receive in regards to your
    tickets, the quicker we will process your ticket order. Please trust that we
    will take care of you and your tickets.

    *Muy Importante! TO RECEIVE YOUR TICKETS, YOU WILL NEED TO BRING YOUR CONFIRMATION NUMBER AND A VALID PHOTO ID TO THE TEN CLUB TICKET WINDOW, AT THE VENUE BOX OFFICE, ON THE DAY OF THE SHOW. NO TICKETS WILL BE ISSUED WITHOUT THE CONFIRMATION NUMBER AND VALID ID. No exceptions. Tickets will not be distributed prior to the show date, to avoid any scalping issues with fan club tickets.

    *Seat selection will be based upon seniority in the club; meaning the longer
    you have been in the club, the closer your seats will be to the front of the
    stage. The Ten Club reserves the "best seats in the house" for 10c members.
    These seats will be on the floor from the front row, extending back. You
    will not be notified of your seat selection until the day of the show, when
    you receive your tickets. Please note, seat selection will be effected by
    the popularity of the show. Meaning, if you choose to attend a show in a
    bigger city, your seat selection may not be as close as expected. But if you
    choose a city that is not as popular, your chances for getting seats closer
    to the stage are greater.

    *The Ten Club ticket window at the venue box office will open at 3pm on the
    day of each show, unless otherwise posted. We will post these specific box
    office times in the NEWS section of http://www.tenclub.net. Early arrival to the
    box office will not improve the quality of your seats, as seat selection
    will be predetermined. However, please don't wait until show time to pick
    up your tickets, as there will be a line and you may miss part of the show.
    AND ALSO REMEMBER, THE TEN CLUB TICKET WINDOW WILL CLOSE 15 MINUTES AFTER
    PEARL JAM TAKES THE STAGE.

    * This document will be posted on our site http://www.tenclub.net for your
    convenience. Questions or concerns regarding your fan club tickets can be
    directed to tickets@tenclub.net. Or you may call the Pearl Jam hotline
    206/728-7078 for more information.

    LOL, keep up!!! Pearls&Stones was responding to luckytwn, and Solat13 was posting the 2003 email because luckytwn said it might not have been so stated back during the block ticketing days.

    Pass that shit over here, man! :D

    How are you doing? Are you hitting the Philly shows next week? I hope all has been well for you since running into you in Canada.

    Cool, I'll pm her next week. I'm actually heading to her workplace to make my monthly platelet donation. She helped get me into regularly donating blood and now it's become part of my routine.

    I believe the band prefers to have the senior members up front. First night in Chicago, Ed pointed out this guy who he says was at their first show under "Mookie Blaylock". Also, Ed must of passed out at least 8 tamborines for both shows, and it wasn't a random toss into the crowd, he hand picked who got it, so I'm assuming he is rewarding people who show up all the time.

    Good point, but at the same time, watch the Letterman video. If this show is representative of the typical front rows, then PJ nation could use some aerobic activity and a better diet.

    You're coming off as more of a fucking douchebag with each successive post, lest you didn't already know that. Not to say that your command of this excruciatingly banal material (and your will to recite and repeat it) is anything less than tragically and pathetically strong...it is...but you're simply being a hairy, dry cunt while discussing it. So stop.

    Here is a specific quote from the January 23, 2003 e-mail announcing the 2003 Tour and 10c instructions:
    ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
    *The Ten Club ticket window at the venue box office will open at 3pm on the
    day of each show, unless otherwise posted. We will post these specific box
    office times in the NEWS section of http://www.tenclub.net. Early arrival to the
    box office will not improve the quality of your seats, as seat selection
    will be predetermined. However, please don't wait until show time to pick
    up your tickets, as there will be a line and you may miss part of the show.
    AND ALSO REMEMBER, THE TEN CLUB TICKET WINDOW WILL CLOSE 15 MINUTES AFTER
    PEARL JAM TAKES THE STAGE.
    ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
    And then they did blocks instead. A couple of shows into the USA portion, someone said what was happening; his experience. Then there were 1000 threads of outcry, confusion, speculation, etc. In one of those threads, Tim (Rubysdad) confirmed blocks. However, no other announcement was made. I always thought one should use the same means to state a change as you used in the original announcement. In this case, e-mail and website. There was a lot of discussion and debate then, including sides vs. rear floor. To see that they are doing what they said here in 06 is great.

    I know, but luckytwn was looking for the 2003 tour email. So I thought I'd help out.

    You really saved my ass from having to search an old hard drive. I owe you one!

    they should just get rid of the seats on the floor and then it will be like firrst come first serve, you have floor ticket which i usualy get and lots of members here get unless your number is real high, and then it first come first serve when the floor opens. and dont whine about mosh pits etc, i dont think they be a very big one much more.

    too bad pj didnt play more outdoor venues this tour, they are better for seating and less people would bitch they got shitty 10 c seats. on a floor in an arena if you are 30 row back or something its not always good. but in ampatheaters all the seats are elavated i think less people would whine.

    OK two main things:
    1. The guys that got front row with numbers 130xxx were super psyched and never got that close before so that was really cool and I think they should mix up the seating to allow for this from time to time.

    2. That said with #105xxx I was thinking this might be my chance to get row 1 since that's only happened for me one other time. I would NOT have taken a day off work and driven to GR from Chicago with my wife if I had known I would be way up in row R on the side of the stage right in front of an overcrowded luxury suite of screaming idiots (ruining hard to imagine). I could have planned to sell the tickets, upgrade or whatever. Many TM buyers had better seats than 10C. I also only went to Chicago and here. I'm not one of the people that go to 20+ shows a tour. I'd like a chance at a great seat too. Just let us know the deal and we'll adapt. But shortchanging people like a girl that drove all the way from Iowa, two women next to us that came from Inidiana for their only show of the tour. Those folks got royally screwed.

    I also don't think this was a mistake. Eddie said a few negative things about chicago and "Grand rapids who would of knew". I got an envelope with ten club and my name and # printed on it. Unlike in chicago. Seemed very deliberate.

    Also the crowd was way more into it tonight. But I think our section of #s 45xxx-108xxx was up and moving considering where we were and if things had gone according to plan the floor with us in it would have been just as amped. Great set, show etc. etc.

  • This probably wasn't a mistake. From what I saw at the Chicago shows, they had their shit together back there with the tickets. They probably just said, "Hey, what the fuck? Let's give the younger guys a great night."

    Which leads me to say this: I thought about going to tonight's show, driving from Chicago, primarily because my # is fairly low, and I wanted the chance to be really close. Now, I was in the 13th and 11th row, dead in front of mike both nights in Chicago, so I don't have shit to complain about...But I thought I could get very close in MI. If this had happened when I went, I would have been mad. UNLESS I WAS IN THE FIRST ROW.

    So basically, I just say fuck it. I hope the guys with the high numbers got to see the shit up close. Treasure it. Doesn't it make you smile?

    Yeah well whatever. Fine, lets all accept that PJ has some legal responsibility here.

    What are you gonna do - sue Pearl Jam because your 10c seats weren't in the first row?

    "Yes your honor, I love Pearl Jam so much, I paid $15 a year - yes, a whole $15 a year - since 1993, and now I love them so much that I'm suing their ass for breach of contract because I had to sit 10 rows up on the side - Stone's side, no less. I learned absolutely nothing from watching the band's legal battles and stance against ticketmaster, nor have I managed to gain even an iota of understanding what this whole scene is about through my many shows and yars of fandom. I AM A HUGE ASSHOLE. IM GOING TO MAKE SELLING TICKETS THROUGH TICKETMASTER LOOK, TO JEFF AMENT AND ED VEDDER, LIKE THE GREATEST FUCKING IDEA ANYONE EVER THOUGHT OF - THAT'S JUST HOW MUCH OF AN ASSHOLE I CAN BE!"

    I mean, really, PJ has a legal obligation? Fine. Anyone who holds them to it needs a fucking life. What will you do, sue them for the right to play in your backyard? Why not sue McDonalds over getting fat - at least then you'll find a whole bunch of other assholes who will agree with you and take your side.

    Just so fucking unbelievable!!
